479 ANNO VICESI M O SECUN ELIZABETHAE SEC UN DAE REG INA E 19 7 3 An Act Act I._, Cook Unhh [ASSENTED TO 22ND OCTOBER, 1973] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation. (1) This Act may be cited as the James Cook University of North Queensland Act Amendment Act 1973. (2) The James Cook University of North Queensland Act 1970 is in this Act referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the James Cook University of North Queensland Act1970-1973.
480 James. Cook University, Etc., Act Amendment Act 1973, No. 52 2. Amendment of s. 3. Section 3 of the Principal Act is amended by, in the meaning of the expression " permanent academic staff ", omitting the word " demonstrator " and inserting in its stead the word " tutor ". 3. Amendment of s. 17. Section 17 of the Principal Act is amended by, in subsection (1), adding to the words contained within brackets, after the words "Statutes or Rules ", the words " and its duties in relation to the annual adoption of a budget and the approval of the proposed distribution of funds referred to in subparagraph (ii) of paragraph (c) of section 16 of this Act ". 4. Amendment of s. 18. Section 18 of the Principal Act is amended by, in paragraph (d) of subsection (1), omitting the words " full-time members of the teaching and research " and inserting in their stead the words " permanent academic ". by- dment of s. X. Section 34 of the Principal Act is amended (a) in subsection (3), omitting the expression " subsection (4) " and inserting in its stead the expression " subsections (4) and (5) "; (b) inserting after subsection (3) the following subsection:- " (4) In any case where the Council has brought into any investment common fund, moneys which, having been received by it to be expended for a stated purpose, cannot or will not be expended for that purpose forthwith, there may be paid into the general funds of the University the whole or any part of that part of the income of such investment common fund which is attributable to the participation of those moneys in that fund and which is not required for that stated purpose."; (c) renumbering the existing subsections (4), (5) and (6) as subsections (5), (6) and (7) respectively. 6. Amendment of s. 38 . Section 38 of the Principal Act is amended by, in subsection (4), inserting at the end thereof after the word " University " the words " and the manner of operating and maintaining the accounts ". 7. Savings. Notwithstanding the amendment of section 18 of the Principal Act by section 4 of this Act, any person who was a member of Convocation pursuant to paragraph (d) of subsection (1) of the said section 18 prior to the commencement of this Act shall remain eligible
