  1. The applicant requires an extension of time in order to bring his application for special leave to appeal.  To grant an extension would be futile.  The proposed appeal would not enjoy sufficient prospects of success to warrant the grant of special leave.  In any event, no question of principle arises on the application.

  2. The application for special leave to appeal should be dismissed.

  3. Pursuant to r 41.08.1 we direct the Registrar to draw up, sign and seal an order dismissing the application with costs.
