Jabiru Town Development (Chemical Preparations) By-laws 1983

By-laws under the Jabiru Town Development Act 1978

1Citation

These By-laws may be cited as the Jabiru Town Development (Chemical Preparations) By-laws 1983.

2Definitions

In these By-laws, unless the contrary intention appears:

permit means a permit granted under by-law 5.

town area of Jabiru means the area administered by the Authority.

Town Manager means the person employed by the Authority as the town manager of Jabiru, and includes a person authorized by the Authority to act in his place.

3Use of chemical preparations

A person shall not bring into, sell or use within the town area of Jabiru a chemical preparation specified in the Schedule unless he does so in accordance with a permit.

Penalty:          $500.

4Application for permit

A person who carries on a business of insect or pest control may apply to the Town Manager for a permit to bring into and use within the town area of Jabiru, a chemical preparation specified in the Schedule.

5Town Manager may grant permit

Where a person has applied under by-law 4 for a permit, the Town Manager may grant him a permit in a form and for a period as he thinks fit.

6Town Manager may cancel permit

Where a person who has been granted a permit contravenes these By-laws or acts otherwise than in compliance with the permit, the Town Manager may, by notice in writing to the person, cancel the permit.

7Disposal of container

Where a person has, in accordance with his permit, brought into and used within the town area of Jabiru a chemical preparation specified in the Schedule, he shall dispose of the container in which the chemical preparation was kept in accordance with his permit.

Penalty:          $500.
