ORDER solicitors acting for both parties well knew of the necessity for the appearance before me today. I expect a written explanation from both parties to be provided to my Associate today to explain the discourtesy in not attending Court today.

The position is this: a Notice of Appeal was filed on the 9th of August 2005. The matter is listed for hearing on the 15th of November this year. There was delay in providing the settled index to the record book and as at today the record book has not yet been filed. This is completely unsatisfactory as the matter is listed in less than two weeks time for hearing.

I order that the appellant file and serve the record book by 4.00 p.m. on Monday next. In default, the matter is to be listed before me to show cause why the appeal should not be struck out for want of prosecution.
