An Act to make further provision for the Issue

of Process at Circuit Towns. [7th April, 1866.]

WH E R E A S it is expedient to ex tend the provisions of t h e A c t	passed in t h e t h i r t e e n t h year of t h e re ign of H e r Majesty	Queen
Vic tor ia in t i tu led "An Act to make further	provision	for the issue and

service of Process	in the Supreme	Court"	Be i t enacted by t h e
Queen ' s	Mos t	Exce l l en t	Majesty by and wi th t h e advice a n d consent

of t h e Legis la t ive Council a n d Legislat ive Assembly of N e w South

W a l e s in Pa r l i amen t assembled a n d by t h e au tho r i t y of t h e same as

fo l lows:—

1. I t shall be lawful for t h e J u d g e s of t h e Supreme Cour t

by a n y genera l R u l e or R u l e s from t i m e to t ime made to empower any

Commissioner of t h e said Cour t for t a k i n g affidavits u n d e r such regula t ions as to t h e said J u d g e s shall seem proper to receive any praecipe for a n d to issue a t any Circui t Town now or hereafter to be appoin ted any W r i t of S u m m o n s of t h e said Cour t and also any W r i t

of Subpoena to give evidence in any case Civil or Cr imina l Provided

t h a t every such W r i t of S u m m o n s shall be r e tu rnab le in t he Supreme Cour t a t Sydney and t h a t every such praecipe shall as soon as con­ venient ly m a y be after t h e issue of t h e W r i t to which t h e same

relates be t r a n s m i t t e d by t h e Commissioner who received the same

to t h e office of t h e P r o t h o n o t a r y of t h e said Court .
