CaseChat Overview and Summary

The applicants, ISS Health Services Pty Ltd and Blurlato Pty Ltd trading as ISS Facility Services, applied to the Fair Work Commission for approval of the ISS Facility Services Public Hospitals (Victoria) Enterprise Agreement 2017. The application was opposed by the Health Services Union of Australia, which raised concerns about the agreement's provisions relating to employee entitlements, particularly in relation to annual leave, shift penalties, and the use of casual employees. The case was heard in the Fair Work Commission, which had to determine whether the agreement met the statutory requirements for approval under the Fair Work Act 2009.

The key legal issues before the Commission were whether the provisions of the enterprise agreement were fair and reasonable, and whether they complied with the relevant statutory provisions. The Commission had to consider the provisions of the agreement in light of the principles of enterprise bargaining set out in the Fair Work Act, and determine whether the agreement was likely to have a positive effect on the productivity, efficiency and profitability of the enterprise. The Commission also had to consider whether the agreement provided for fair and reasonable terms and conditions of employment, and whether it was likely to promote harmonious, productive and cooperative workplace relations.

In its decision, the Commission found that the provisions of the enterprise agreement were fair and reasonable, and complied with the statutory requirements for approval. The Commission noted that the agreement provided for a range of benefits for employees, including increased wages, improved leave entitlements, and better shift penalties. The Commission also found that the agreement was likely to have a positive effect on the productivity, efficiency and profitability of the enterprise, and that it promoted harmonious, productive and cooperative workplace relations. The Commission accepted the applicants' submissions that the use of casual employees was necessary to meet the fluctuating demands of the public hospital industry, and that the agreement provided for appropriate protections for these employees.

The Commission approved the ISS Facility Services Public Hospitals (Victoria) Enterprise Agreement 2017, subject to certain modifications to the agreement to address the concerns raised by the Health Services Union of Australia. These modifications included changes to the agreement's provisions relating to annual leave, shift penalties, and the use of casual employees. The applicants were ordered to implement the modified agreement, and to provide the Health Services Union of Australia with a copy of the approved agreement.
