IRRIGATION CORPORATIONS ACT 1994 No. 41—

PROCLAMATION

NEW SOUTH WALES

I, Rear Admiral PETER ROSS SINCLAIR, A.C., Governor of the State
of New South Wales, with the advice of the Executive Council, and in
pursuance of section 2 (1) of the Irrigation Corporations Act 1994, do, by this my Proclamation, appoint 3 February 1995 as the day on which the following provisions of that Act commence:

(a)

Parts 1–7 (excluding sections 6 and 19 (1)–(5) but including section 19 (6));

(b) Schedules 1 and 2;

(c) the amendments in Schedule 3 relating to the Conveyancing Act
19 19, the Dividing Fences Act 1991, the Land and Environment

Court Act 1979 and the Water Act 19 12.

EXPLANATORY NOTE

The object of this Proclamation is to commence provisions of the Irrigation Corporations Act 1994 that enable irrigation corporations to be established and to function. The provisions that actually establish irrigation corporations, and certain consequential amendments to various Acts, remain uncommenced.

Section 2 (2) of the Irrigation Corporations Act 1994 provides that a proclamation is not effective to commence a provision of section 6 (establishment of companies as State owned corporations) or 19 (amendment of State Owned Corporations Act 1989) unless

it specifically mentions the provision. Consequently, sections 6 and 19 (other than
section 19 (6)) are not commenced by this Proclamation.
