No. 44, The Irrigation Acts as amended by this Act may collectively be cited as "The Irrigation Acts, 1922 to 1931," and the Water Acts as amended by this Act may collectively be cited as "The Water Acts, 1926 to 1931." • Commence- *2. Act, and notwithstanding anything to the contrary in to be the any Act or law contained, the Land Administration sCioomnemr ios- f Board constituted for the time being pursuant to the Irrigation provisions of t" The Land Acts Amendment Act of 1931" SanudppWlya. ter (or any Act amending or in substitution of the same), shall, for all purposes of the Irrigation Acts and the Water Acts, by virtue of the provisions of this Act, be and be deemed to be and to constitute the corporate body under the said Acts (such corporate body being under the corporate name of the" Commissioner of Irrigation and Water Supply"), and further, such Land Administration Board shall by virtue of the provisions of this Act be appointed and be and be deemed to be the Commissioner of Irrigation and vVater Supply under the said Acts, and the said Acts and any other Act or law or process of law shall be read and construed accordingly; and without in any wise limiting the generality of the above provisions, the Land Administration Board shall have and exercise all the rights, powers, and authorities and jurisdiction of such corporate body and the Commissioner and shall perform the duties and functions of and be subject to the obligations of such corporate body and the Commissioner. Wherever in the Irrigation Acts or the Water Verbal A C t S reference I . (1.) For the purposes of the Irrigation Acts and Power to the Water Acts, the Commissioner (being the Land ~~~~::s. Administration Board) may from time to time delegate to a member of the Land Administration Board or to the Deputy Commissioner or other officer of the Commissioner such of the powers, functions, and duties conferred or imposed on the Commissioner as the Commissioner (being the Land Administration Board) may think fit, and such delegation may be either for a specified time or without limit of time, and the Commissioner may at any time cancel such delegation. The member of the Board or Deputy Commissioner or other officer as aforesaid to whom such powers or duties are delegated shall to the extent of such delegation and while the same subsists have all the powers and authorities and perform and exercise all the duties and functions of the Commissioner; but no such delegation shall be construed so as to prevent the Commissioner from also exercising any of such powers and authorities or performing any of such duties or functions. * 13 Geo. Amendments to the Irrigation Acts (being *" The Irrigation Act of 1922" as amended by t" The Water Act Amendment Act of 1930"). Section 2. Commis· sioner. The Irrigation Acts are amended as follows : - In section two the definition of " Commissioner" is repealed and the following definition is inserted in lieu thereof : - " " Commissioner"-The Commissioner of Irrigation and Water Supply (being the Land Administration Board constituted for the time being pursuant to the provisions of :j:" The Land Acid Amendment Act of 1931," or a,ny Act amending or in substitution of the same), such Board being deemed to be and to constitute the corporate body by the name of the "Commissioner of Irrigation and Water Supply" and appointed to be the Commissioner pursuant to the provisions of §" The I T'!igation and Water Supply Acts Amendment Act of 1931 " ; " Section 3. Amendment Act of 1930 ") is amended as follows :- (a) In subsection one the words" The Commissioner with the approval of the Minister shall appoint a secretary" are repealed, and the words "The Governor in Council shall appoint a secretary" are inserted in lieu thereof. The following proviso is inserted to subsection one :- "Provided that the Governor in Council may appoint a Deputy Commissioner who may also be and act as and exercise all the powers of and perform all the duties and functions of secretary under this Act and under" The Water Acts, 1926 to 1931," and may hold his office as secretary in conjunction with his office as Deputy Commissioner.' , (b) In subsection two the words "The Commissioner with the approval of the Minister" occurring at the commencement of the subsection are repealed, and the words "The Governor in Council" are inserted in lieu thereof. (c) Subsection three is repealed. (d) Subsection four is repealed. (e) Subsection five is repealed. (f) Subsection six is repealed. (g) Subsection seven is repealed.
