Act N o . 160 , 1979 .
An Act to amend the Irrigation Act, 1912, consequent upon the enactment of the Water (Amendment) Act, 1979; and for other purposes. [Assented to, 10th December, 1979.]
BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—
This Act may be cited as the "Irrigation (Amendment) Act,
1979".
(1) This section and section 1 shall commence on the date
of assent to this Act.
(2) Except as provided in subsection ( 1 ) , this Act shall commence on the day appointed and notified under section 2 (2) of the Water (Amendment) Act, 1979.
3 . The Irrigation Act, 1912, is-amended by inserting after
section 24 the following section :—
24A. The provisions of Part VI of the Water Act, 1912,
in so far as they apply to and in respect of drainage works constructed under that Part, shall apply to and in respect of drainage works constructed under this Act in the same way as they apply to and in respect of drainage works constructed under that Part.
Each Act specified in Column 1 of Schedule 1 is amended
in the manner specified opposite that Act in Column 2 of Schedule
Any drainage works constructed, before the day referred to in section 2 ( 2 ) , under Part VIII of the Water Act, 1912, in the Coomealla Provisional Subsoil Drainage District shall be deemed to have been constructed under the Irrigation Act, 1912, as amended by this Act, as if the Irrigation Act, 1912, as so amended, had been in force at the time they were constructed.

In respect of drainage works constructed, before the day referred to in section 2 ( 2 ) , under Part VIII of the Water Act, 1912, in the Coomealla Provisional Subsoil Drainage District, the Water Resources Commission constituted under section 4 of the Water Resources Commission Act, 1976, may, by notification published in the Gazette, waive any rate, or the balance of any contribution, payable under Part VIII of the Water Act. 1912, and outstanding immediately before that day, and the waiver has effect as if that rate or balance had been paid.
