.124 (Queenslanii ANNO QUARTO DECIMO ELIZABETHAE SECUNDAE REGINAE No. 6 of 1965 An Act to Amend "The Irrigation Acts, 1922 to 191," in certain particulars and to Validate a certain Regulation ,ASSENTED TO 8TH APRIL, 1965] BE IT ENAC'T'ED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. t 1 ? Short title. This Act may be cited as " The Irrigation Acts Amendment Act of 1965." (21 Principal Act. " The Irrigation Acts. 1922 to 1961," are in this Act referred to as the Principal Act. (3) Collective title . The Principal Act and this Act may be collectively cited as " The Irrigation Acts, 1922 to 1965.- 2. Amendment of clause 10 of Part I of the Schedule . Clause ten of Part I of the Schedule to the Principal Act is amended by adding thereto the following subclause namely:- (4) Where the Commissioner has entered into a contract for the construction of any works he may, at an) time or from time to time. subject to such conditions as are therein prescribed and approved by the M inister, make advances to the contractor from the proper fund maintained in respect of such works. Such advances may be made before the commencement of the work and may be by way of loans of money on the security of items of plant and construction equipment which are the
Irrigation Acts Amendment Act ff 1965, No. 6 125 unencumbered property of the contractor and which are intended by the contractor to be used by him in the execution of the works. The conditions prescribed in respect of repayment of such an advance may include provision for repayment thereof by way of deductions from progress payments due from time to time by the Commissioner to the contractor." 3. Amendment of clause 33 of Part II of the Schedule . Clause thirty-three of the Schedule to the Principal Act is amended by inserting before the words " determining the time at which " the words and symbols " fixing water charges to be paid by the occupier of land situated within three hundred feet of the middle of a road in which water mains are laid down by the Commissioner; ". 4. Power to make regulation sixteen under Principal Act. It is hereby declared that the power to make regulations under the Principal Act always included power to make the regulation numbered sixteen in the regulations made under that Act and published in the Gazette of the eleventh day of May, one thousand nine hundred and fifty-seven.
