H i n d m a r s h of the second par t t he land specified in the Third Schedule hereto annexed was granted bargained sold al ienated released and confirmed u n t o t he said Bishop of Grafton and Armidale Wi l l i am Clare Cardew and J a m e s H a r v e y H i n d m a r s h to be used as

a site for Church of E n g l a n d purposes A n d whereas i t is expedient
t h a t the said Bishop of Grafton and Armida le Wi l l i am Clare Cardew

J a m e s H a r v e y H i n d m a r s h and George Thomas Thankfu l Bu t l e r should be empowered to sell and dispose of t h e said parcels of land and to convey and assure t he same according to the i r respect ive in teres ts to t h e respective purchasers thereof free and discharged from the t rus ts incident there to A n d t h a t t he proceeds of sale in each case should be invested in premises as hereinaf ter provided Be it therefore enacted by the Queen ' s Most Exce l l en t Majes ty by and wi th the advice and consent of t he Legislat ive Council and Legis la t ive Assembly of New Sou th Wales in Par l iament assembled and by au thor i ty of t he same as follows :—

1. I t shall be lawful for t he said Bishop of Graf ton a n d

H i n d m a r s h and George Thomas Thankful Bu t l e r the i r heirs adminis ­ t ra tors and executors to sell and dispose of t he lands severally described in t he F i r s t Second and 'Third Schedules here to annexed by publ ic auct ion or private; contract and ei ther in one lot or several lots as the vendors exercising this power shall deem expedient lor such price or prices as can be reasonably had or obta ined therefor A n d to convey and assure t h e same or any par t thereof to t h e respect ive purchasers thereof in fee-simple freed and discharged from the t rus ts affecting t h e same A n d the receipt in wr i t ing of the said Bishop of

Grafton and Armida le or his successors W i l l i a m Clare Cardew J a m e s
H a r v e y Hindmarsh and George Thomas Thankfu l Bu t l e r or the i r heirs

admin i s t ra to r s and executors shall be an. absolute discharge to every purchaser of such lands or of any par t thereof in respect to the pur­ chase money payable by h im a n d shall exonera te h im from seeing to t he appl icat ion thereof and from all l iabil i ty as to t he mis-appl icat ion

or non-appl icat ion thereof.

2. The said Bishop of Graf ton and Armida le and his successors

Thankfu l B u t l e r thei r heirs adminis t ra tors and executors shall s tand possessed of all moneys ar is ing from the exercise of the powers of sale hereby conferred after p a y i n g the reou t t he costs of ob ta in ing

th is p resen t Ac t and all expenses inc ident t o t he sale of t he said lands

upon the following t rus t s namely :—-

(i)   In the first place to apply such moneys or any part thereof in or towards p a y m e n t for purchase of one acre of land adjoining the bui ld ing now used as a Church of E n g l a n d in Lawrence- street Invere l l on which is erected a subs tan t ia lbr ick dwell ing- house and to pe rmi t t h e same to be used as a dwel l ing-house for t he minis ter licensed and authorized to officiate in t he said chu rch adjoining.

( i i ) A n d to apply t he residue of t he said moneys if a n y in or

towards paymen t of t he debt now due on t h e said bui ld ing

used as a chu rch in Lawrence-s t ree t aforesaid.
