An Act to amend the Coroners Act 1956 and the Crimes Act 1900 consequent on the enactment of the Intoxicated Persons (Care and Protection) Act 1994

The Legislative Assembly for the Australian Capital Territory enacts as follows:
Short title
1. This Act may be cited as the Intoxicated Persons (Consequential Amendments) Act 1994.
Commencement
2. (1) Section 1 and this section commence on the day on which this Act is notified in the Gazette.
(2) The remaining provisions commence on the day on which section 3 of the Intoxicated Persons (Care and Protection) Act 1994 commences.
Coroners Act 1956
3. Section 2 of the Coroners Act 1956 is amended—
(a)by omitting from paragraph (e) of the definition of “custodial officer” in subsection (1) “or” (last occurring);
(b)by adding at the end of paragraph (f) of the definition of “custodial officer” in subsection (1) “or”;
(c)by adding at the end of the definition of “custodial officer” in subsection (1) the following paragraph:
“(g)a carer within the meaning of the Intoxicated Persons (Care and Protection) Act 1994;”;
(d)by omitting from paragraph (2) (d) “or” (last occurring);
(e)by adding at the end of paragraph (2) (e) “(other than a custodial officer referred to in paragraph (g) of the definition of ‘custodial officer’ in subsection (1)); or”;
(f)by inserting after paragraph (2) (e) the following paragraph:
“(f)while at a licensed place within the meaning of the Intoxicated Persons (Care and Protection) Act 1994;”;
and
(g)by omitting from subsection (2) “(e)” (last occurring) and substituting “(f)”.
Crimes Act 1900
4. Section 351 of the Crimes Act 1900 is repealed.
