Interstate Road Transport Regulations 2(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Interstate Road Transport Act 1985.

1.   Amendment

1.1   The Interstate Road Transport Regulations are amended as set out in these Regulations.

 These Regulations commence on gazettal: see Acts Interpretation Act 1901, s.48]

 

2.   Regulation 2 (Interpretation)

2.1   Subregulation 2 (1) (definition of ‘national standard’):

Omit “‘national standard’ means a national standard under the Motor Vehicle Standards Act 1989;”.

  

3.   Regulation 5A (Maximum road speed limiting—heavy motor vehicles)

3.1   Paragraph 5A (1) (aa):

Add at the end “and”.

  

4.   Regulation 12A (Permitted gross mass limits)

4.1   Subregulation 12A (2):

Omit “a” (second occurring).

  

5.   Regulation 12O (Dimensions of a B-double—height)

5.1   Subregulation 12O (1):

After “vehicle’s”, insert “load and”.

5.2   Subregulation 12O (2):

Omit “livestock” (first occurring).

 

5.3   Paragraph 12O (2) (c):

Omit the paragraph, substitute:

  • “(c)

    when the trailer consists of a multi-deck stock crate and livestock are carried on the top deck—if each lower deck is fully laden.”.

  

6.   Regulation 12ZA (Distribution of load)

6.1   Omit the regulation, substitute:

 

Distribution of Load

 “12ZA. (1)  For each axle group on a B-double, the ratio of the load borne by the axle group to its maximum legal load must not vary by more than 20% from the equivalent ratio for any other axle group on the B-double.

 
  • “(2)

    In subregulation (1) ‘axle group’ does not include:

  • (a)

    a steering axle; or

  • (b)

    an axle group equipped with a variable proportioning brake system or an anti-lock braking system.”.
