Interstate Road Transport Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Interstate Road Transport Act1985.

1.   Amendment

1.1   The Interstate Road Transport Regulations are amended as set out in these Regulations.

[NOTE:

 These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   Regulation 2 (Interpretation)

2.1   Insert the following definitions:

‘inspector’ has the same meaning as in subsection 44 (7) of the Act;

‘police officer’ has the same meaning as in subsection 44 (7) of the Act;”.

3.   Heading of Division 1 of Part II

3.1   Omit the heading, substitute:

“Division 1—Requirements for the purposes of paragraph 13(1)(a) of the Act”.

4.   Regulation 12A (Permitted gross mass limits)

4.1   Subregulation 12A (2):

Omit the subregulation, substitute:

“(2)

In spite of subregulation (1):

  • (a)

    the gross combination mass of a vehicle comprising:

    • (i)

      a trailer or trailers, other than the combined semi-trailers of a B-double; and

    • (ii)

      the motor vehicle drawing the trailer or trailers;

 must not exceed 42.5 tonnes; and

  • (b)

    the gross mass of a trailer or the gross combination mass of trailers, other than the combined semi-trailers of a B-double or a semi-trailer, must not exceed the gross mass of the motor vehicle drawing the trailer or trailers.”.

5.   Regulation 12H (Overloaded vehicle):

5.1   Paragraphs 12H (1) (a), (b) and (c):

Add at the end of each paragraph “or”.

5.2   Subregulation 12H (1):

Add at the end:

  • “; or (f)

    in the case of a vehicle comprising:

    • (i)

      a trailer or trailers, other than the combined semi-trailers of a B-double; and

    • (ii)

      the motor vehicle drawing the trailer or trailers;

  exceeds in combination a gross mass of 42.5 tonnes.”.
