Interstate Road Transport Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Interstate Road Transport Act 1985.

1.   Commencement

1.1   These Regulations commence on 1 July 1995.

2.   Amendment

2.1   The Interstate Road Transport Regulations are amended as set out in these Regulations.

3.   Regulation 2 (Interpretation)

3.1   Subregulation 2 (1) (definition of “axle group”):

Omit the definition, substitute:

“‘axle group’ means a single steer axle, a single axle, a single axle group, a tandem axle group, a twin-steer axle group, a triaxle group, a quad axle group or a close coupled axle group;”.

3.2   Subregulation 2 (1) (definition of “single axle”):

Omit the definition, substitute:

“‘single axle group’ means a group of 2 or more axles in which the horizontal distance between the centre-lines of the outermost axles is less than 1 metre;”.

3.3   Subregulation 2 (1) (definitions of “compliance plate”, “higher mass limit”, “prescribed axle group” and “the Charge Regulations”):

Omit the definitions.

3.4   Subregulation 2 (1) (definition of “conforming vehicle”):

Subparagraph (a) (ii):

Omit the subparagraph, substitute:

  • “(ii)

    an axle included in any of a single axle group, a twin steer axle group, a tandem axle group, a triaxle group, a quad axle group or a close coupled axle group; and”.

3.5   Subregulation 2 (1) (definition of “semi-trailer”):

Paragraph (a):

After “has a”, insert “single axle or”.

3.6   Subregulation 2 (1):

Insert the following definitions:

“‘quad axle group’ means a group of 4 axles, in which the horizontal distance between the centre-lines of the outermost axles is more than 3.2 metres but not more than 4.9 metres;

‘retractable axle’ means an axle that can be raised so that the tyres on the axle do not touch the ground;

‘the Charge Act’ means the Interstate Road Transport Charge Act 1985;

‘type’, in relation to a vehicle, means:

  • (a)

    if the vehicle is a motor vehicle—a type specified in Division 1 or 3 of Part 2 of the Schedule to the Charge Act; or

  • (b)

    if the vehicle is a trailer—any type of trailer to which the Charge Act applies.”.

3.7   Paragraph 2 (3) (d):

Omit “group or”, substitute “group, a quad axle group or”.

4.Regulation 5A (Maximum road speed limiting—heavy motor vehicles)

4.1   Subparagraph 5A (1) (a) (iii):

Omit “and” (second occurring).

5.   Regulation 12B (Axle loads)

5.1   Paragraphs 12B (1) (c), (d) and (e):

Omit the paragraphs, substitute:

  • “(c)

    for an axle group of a kind specified in column 2 of an item in Schedule 1B—the axle load limit specified in column 3 of that item for that axle group.”.

5.2   Subregulation 12B (2):

Omit the subregulation, substitute:

“(2)

For the purposes of paragraph (1) (a), the mass limit on a tyre is the greatest load capacity determined for the tyre by the manufacturer at a cold inflation pressure that does not exceed:

  • (a)

    for a radial ply tyre—825 kilopascals; or

  • (b)

    for any other tyre—700 kilopascals.”.

5.3   Regulation 12B:

Add at the end:

“(3)

For the purposes of paragraph (1) (c), if an axle group of a kind specified in Schedule 1B includes a retractable axle, the axle load limit for that group must be determined as if that axle did not exist, unless subregulation (4) applies.

“(4)

A retractable axle is part of an axle group for the purposes of Schedule 1B if, when the mass on the group exceeds:

  • (a)

    in the case of a tandem axle group—6 tonnes; or

  • (b)

    in the case of a triaxle group—11 tonnes;

the tyres on the axle touch the ground and there is load sharing on each axle (including the retractable axle) and tyre in the group.”.

6.   Regulation 12C (Operation of vehicle at higher mass limit)

6.1   Omit the regulation.

7.   Regulation 12D (Certain vehicles not to operate at higher mass limit)

7.1   Omit the regulation.

8.   Regulation 12E (False statement of gross vehicle mass)

8.1   Paragraph 12E (a):

Omit the paragraph.

9.   Regulation 12F (Registration Authority may request documentation)

9.1   Omit the regulation.

10.   Regulation 12G (Inspection of vehicles—mass limits)

10.1   Omit the regulation.

11.   Regulation 12H (Overloaded vehicle)

11.1   Paragraph 12H (1) (a):

Omit the paragraph, substitute:

  • “(a)

    if charge has been paid in respect of the registration of the vehicle as a vehicle of a particular type—exceeds in gross mass the MRC for a vehicle of that type; or”.

11.2   Subregulation 12H (1):

The following note is taken to be added at the end:

“[Note:   Subsection 3 (1) of the Act contains the following definitions:

‘compliance plate’ means a plate authorised to be placed on a vehicle, or taken to have been placed on a vehicle, under the Motor Vehicle Standards Act 1989;

‘MRC’ (Mass Rating for Charging), in relation to a vehicle, means:

(a)

the maximum mass of the vehicle, including any load, recorded on  the compliance plate as the GVM, GTMR or ATM of the vehicle; or

(b)

in relation to a vehicle for which there is no compliance plate—its  operating mass.]”.

12.   Regulation 12Q (Dimensions of a B-double—minimum axle spacings)

12.1   Paragraph 12Q (a):

After “axle”, insert “or single axle group”.

13.   Regulation 13 (Inspection in contemplation of registration)

13.1   Subregulation 13 (3):

Omit the subregulation.

14.   Regulation 21 (Registration plate)

14.1   Subparagraph 21 (2) (b) (i):

Omit all the words after “motor vehicle”, substitute “—the letter V or X; or”.

14.2   Subparagraph 21 (2) (b) (ii):

Omit the subparagraph.

14.3   Paragraph 21 (2) (ba):

Omit the paragraph.

14.4   Paragraph 21 (2) (c):

Omit “subject to paragraph (ba),”.

15.   Regulation 27 (Period specified for purposes of paragraph 9 (3) (b) of the Act)

15.1   Add at the end:

  • “; (c)

    in any other case—a period expressed in months.”.

16.   New regulation 29A

16.1   After regulation 29A, insert in Part II:

Vehicle to be operated according to registration

 “29A.Except with reasonable excuse, the owner of a motor vehicle or trailer must not operate it, or allow it to be operated, except as a vehicle of the type for which charge has been paid or, under subsection 5 (2) of the Charge Act, is taken to have been paid, in respect of its registration.

Penalty: 10 Penalty units.”.

17.   Part III (Charge monitoring devices)

17.1   Omit the Part.

18.   Regulation 48A (Fees)

18.1   Paragraph 48A (1) (a):

Omit the paragraph.

18.2   Paragraph 48A (1) (b):

Omit “in any other case—”.

18.3   Paragraph 48A (2) (a):

Omit the paragraph.

18.4   Paragraph 48A (2) (b):

Omit “in any other case—”.

19.   Regulation 49A (Payment of charge etc. by instalments)

19.1   Omit the regulation.

20.   Regulation 51A (Certificate evidence)

20.1   Paragraph 51A (1) (b):

Omit “Charge Regulations”, substitute “Charge Act”.

20.2   Paragraph 51A (2) (e):

Omit all the words after “not,”, substitute “a single steer axle, a single axle, a single axle group, a twin steer axle group, a tandem axle group, a triaxle group, a quad axle group or a close coupled axle group;”.

20.3   Subregulation 51A (4):

Omit “vehicle, or that the vehicle is registered to operate at the higher mass limit in respect of the vehicle, as the case may be,”, substitute “vehicle”.

20.4   Paragraph 51A (4) (a):

Omit “certificate or is the higher mass limit in respect of that vehicle, as the case requires;”, substitute “certificate;”.

21.   Schedule 1B (Axle group table)

21.1   Omit the Schedule, substitute:
