No. 34 of 1957.

AN ACT to amend Section Thirty-six of the

Interpretation Act, 1918-1954.

[Assented to 5th November, 1957.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title

1. (1) This Act may be cited as the Interpretation

and citation.

Interpretation.

(3) The principal Act as amended by this Act

may be cited as the Interpretation Act, 1918-1957.

2. Section thirty-six of the principal Act is

amended.

(a)

by inserting a new subsection after sub- section (2) to stand as subsection (2A) as follows:—

(2A) Notwithstanding any provision in any Act to the contrary, if both Houses of Parliament at any time pass a resolu- tion originating in either House amending or varying any such regulation or sub- stituting another regulation or part of a regulation for that which has been dis- allowed by either House under subsection (2) of this section, then on the passing of any such resolution-

(i)    amending or varying a regulation or part of a regulation the regu- lation or part of a regulation so amended or varied shall, after the expiration of seven days from the publication in the Gazette of the notice provided for in the next subsection of this section, take effect as so amended or varied;

(ii)    substituting a regulation or part of a regulation in place of a regulation disallowed the regula- tion or part of a regulation so substituted s h a 11, after the expiration of seven days from the publication in the Gazette of the notice provided for in the next subsection of this section, take effect in place of that for which it is so substituted. ;

(b)

by inserting after the figure "(2)" in the second line of subsection (3) the passage "or (2A)"; and

(c)

by adding at the end of subsection (3) the words "within twenty-one days of the passing of the resolution. Provided that no regulation published in the Gazette prior to the first day of January, one thousand nine hundred and forty-nine shall be amended or varied or another regulation substituted for it pursuant to the provisions of sub- section (2A) of this section."
