Interim Planning (Amendment) Act 1991

An Act to amend the Interim Planning Act 1990

The Legislative Assembly for the Australian Capital Territory enacts as follows:

Short title

1.  This Act may be cited as the Interim Planning (Amendment) Act 1991.

Principal Act

2.  In this Act, “Principal Act” means the Interim Planning Act 1990.1

Interim effect of draft Plan variations

3.  Section 9 of the Principal Act is amended—

(a)by omitting from the end of paragraph (b) of the definition of “defined period” in subsection (2) “or”; and

(b)by inserting after paragraph (b) of that definition the following paragraph:

“(ba)the date the Executive revokes its approval of the variation; or”.

Executive powers

4.  Section 19 of the Principal Act is amended by adding at the end the following subsections:

“(3)  The Executive may revoke its approval of a Plan at any time before the Plan is laid before the Legislative Assembly.

“(4)  Where the Executive revokes its approval of a Plan it shall cause to be published in the Gazette a notice stating—

(a)that the approval of the Plan has been revoked; and

(b)in the case of a Plan variation—the effect of section 9 in relation to the revocation of the approval.”.
