Application for approval of the Integrated Steel Mill Services Pty Ltd On Site BlueScope & Coated Products Port Kembla Enterprise Agreement 2023
An application has been made for approval of an enterprise agreement known as the Integrated Steel Mill Services Pty Ltd On Site BlueScope & Coated Products Port Kembla Enterprise Agreement 2023 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by Integrated Steel Mill Services Pty Ltd T/A Steelstone Sydney. The Agreement is a single enterprise agreement.
I am satisfied that each of the requirements of ss.186, 187 and 188 are relevant to this application for approval and have been met. The Agreement does not cover all of the employees of the employer, however, taking into account the factors in ss.186(3) and (3A) I am satisfied that the group of employees was fairly chosen.
I observe that certain provisions of the Agreement are likely to be inconsistent with the National Employment Standards (NES). However, noting clause 1.4 of the Agreement, I am satisfied the more beneficial entitlements of the NES will prevail where there is an inconsistency between the Agreement and the NES.
Pursuant to s.202(4) of the Act, the model flexibility term prescribed by the Fair Work Regulations 2009 is taken to be a term of the Agreement.
The Australian Workers’ Union, being a bargaining representative for the Agreement, has given notice under s.183 of the Act that it wants the Agreement to cover it. In accordance with s.201(2) I note that the Agreement covers the organisation.
The Agreement is approved and in accordance with s.54, will operate from 23 June 2023. The nominal expiry date of the Agreement is 30 June 2025.

CaseChat Overview and Summary
The legal issues before the court required determining whether the agreement met the statutory requirements under the Fair Work Act 2009. Specifically, the court needed to assess if the agreement provided for the fair treatment of employees, including minimum wages, penalty rates, and other conditions of employment, and if it adhered to procedural fairness by ensuring genuine bargaining took place. Additionally, the court examined whether the agreement was consistent with the national system of industrial determination.
The Fair Work Commission, after considering the evidence and submissions, found that the agreement was compliant with the statutory requirements. The court noted that the agreement provided for fair and reasonable terms and conditions of employment, including minimum wages and penalty rates. The evidence presented demonstrated that the bargaining process was genuine and that the agreement reflected the terms negotiated between the employer and the employees' representatives. Consequently, the court approved the agreement, finding it to be fair and reasonable in all respects. The court's decision was grounded in the comprehensive evidence of the bargaining process and the fairness of the terms within the agreement.
The final orders of the court were that the Integrated Steel Mill Services Pty Ltd On Site BlueScope & Coated Products Port Kembla Enterprise Agreement 2023 be approved as a registered agreement under the Fair Work Act 2009. The approval was effective from the date of the decision, ensuring that the terms and conditions outlined in the agreement would apply to the employees covered by the agreement.
