Insurance (Agents and Brokers) Regulations (Amendment)

I. THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Insurance (Agents and Brokers) Act 1984.

1. Commencement

1.1 Regulations 3 and 5 commence on 1 January 1991.

2. Amendment

2.1 The Insurance (Agents and Brokers) Regulations are amended as set out in these Regulations.

3. Regulation 6 (Prescribed fee—paragraph 21 (1) (c) of the Act)

3.1 Subparagraph 6 (a) (i):

Omit “$350”, substitute “$400”.

3.2 Subparagraph 6 (a) (ii):

Omit “$700”, substitute “$800”.

3.3 Paragraph 6 (b):

Omit “$700”, substitute “$800”.

4. Regulation 9 (Fees for inspection and copying of documents—section 23)

4.1 Subregulation 9 (1):

Omit “$5”, substitute “$10”.

4.2 Subregulation 9 (2):

Omit the subregulation, substitute:

“(2) The Commissioner must:

(a) on the request of a person: and

(b) on payment of the fee calculated in accordance with subregulation (3):

provide the person with a copy of the whole or part of a document referred to in paragraph 23 (a), (b), (c), (d) or (e) of the Act.

“(3) The fee payable under subregulation (2) is:

(a) an amount calculated at the rate of $1 for each page of a copy of the whole or part of the document; or

(b) if. at the request of the person, the copy of the document is made available in electronic form—an amount calculated at the rate of $1 for each page of the whole or part of the document that is provided in that form.”.

5. Regulation 10F (Prescribed fee—paragraph 31D (1) (b))

5.1 Subparagraph 10F (a) (i):

Omit “$350”, substitute “$400”.

5.2 Subparagraph 10f (a) (ii):

Omit “$700”, substitute “$800”.

5.3 Paragraph 10f (b):

Omit “$700”, substitute “$800”.

6. Regulation 10j (Fees for inspection and copying of documents-section 31F of the Act)

6.1 Subregulation 10j (1):

Omit “$5”. substitute “$10”.

6.2 Subregulation 10j (2):

Omit the subregulation, substitute:

“(2) The Commissioner must:

(a) on the request of a person; and

(b) on payment of the fee calculated in accordance with subregulation (3):

provide the person with a copy of the whole or part of a document referred to in paragraph 31k (a), (b), (c) or (d) of the Act.

“(3) The fee payable under (2) is:

 

(a) an amount calculated at the rate of $1 for each page of a copy of the whole or part of the document; or

(b) if, at the request of the person, the copy of the document is made available in electronic form—an amount calculated at the rate of $1 for each page of the whole or part of the document that is provided in that form.”.
