(1.) This Act may be cited as " The Insurance Short title. Acts and Another Act Amendment Act of 1940." If the owner of a motor vehicle or his estate becomes legally liable by way of damages in respect of such motor vehicle for accidental bodily injury (fatal or non-fatal) to a person (not being a person excepted by subsection one of this section) who is a worker within the meaning of t" The Workers' Compensation Acts, 1916 to 1939," then any compensation under such last- mentioned Acts in respect of which the Insurance Commissioner is entitled to be indemnified by such owner or his estate shall be, and it is hereby declared always has been, damages within the meaning of this Act."
