Instrument under Section 37 of the GEMS Act

1. Power

   This legislative instrument is made under section 37 of the GEMS Act.

2. Commencement

   This instrument comes into force on the day after it is registered.

   Note1        The GEMS Regulator may repeal, rescind, revoke, amend, or vary this instrument ― see s 33(3) of the Acts Interpretation Act 1901.

   Note 2        For sunsetting of legislative instruments see Part 6 of the Legislative Instruments Act 2003.

3. Exemption

   I, David Walker, the GEMS Regulator, exempt the Models from the requirements of section 6 of the Determination, subject to the condition specified in section 4.

4. Condition

   The Models are supplied only for use in:

   (a)   the Australia Pacific Liquefied Natural Gas Project; or

   (b)   the Gladstone Liquefied Natural Gas Project.

5. Definitions

   In this instrument:

   Australia Pacific Liquefied Natural Gas Project means the incorporated joint venture of that name between Origin Energy, ConocoPhillips and Sinopec.

   Determination means the Greenhouse and Energy Minimum Standards (Air Conditioners and Heat Pumps) Determination 2013;

   GEMS Act means the Greenhouse and Energy Minimum Standards Act 2012 (Cth);

   GEMS Regulator has the meaning given in section 5 of the GEMS Act.

   Gladstone Liquefied Natural Gas Project means the unincorporated joint venture of that name between Santos, Petroliam Nasional Berhad (PETRONAS), Total and the Korean Gas Corporation (KOGAS).

   Manufacturer means the manufacturer specified in the Schedule.

   Models means the models of air conditioners produced by the Manufacturer specified in the Schedule.
