Instrument under Section 37 of the GEMS Act

  1. I, David Walker, appointed as the GEMS Regulator under section 70 of the GEMS Act, exempt, by this legislative instrument made under section 37 of the GEMS Act, the Models from the requirements of subsection 6(1) of the Determination in relation to all supplies or uses of products of the Models, subject to the condition specified in clause 3 below.

  2. Term

    (a)   This instrument comes into force on the day after it is registered.

    (b)   This instrument will remain in force until:

    (i)it is withdrawn by the GEMS Regulator; or

    (ii)the Determination is revoked,

    whichever occurs first.

  3. Condition

    The Models comply with the specified energy use requirements in subsection 6(3) of the Determination, being the alternative initial efficacy requirement set out in clause 4.3 of AS 4934.2-2011.

  4. Interpretation  

    In this instrument:

    “Determination” means the Greenhouse and Energy Minimum Standards (Incandescent Lamps for General Lighting Services) Determination 2012;

    “GEMS Act” means the Greenhouse and Energy Minimum Standards Act 2012 (Cth);

    “Models” means the mains voltage halogen non-reflector lamps specified in the Schedule; and

    “Schedule” means the attached schedule to this instrument.
