Instrument to Reduce Appropriations (No. 1 of 2013-2014)

Annual Appropriation Acts

I, Penelope Ying Yen Wong, Minister for Finance and Deregulation, make the determinations in this instrument under the following provisions:

  • section 10 of Appropriation Act (No. 1) 2012-2013;

  • section 12 of Appropriation Act (No. 1) 2012-2013;

  • section 13 of Appropriation Act (No. 2) 2012-2013;

  • section 11 of Appropriation (Parliamentary Departments) Act (No. 1) 2012-2013;

  • section 13 of Appropriation Act (No. 4) 2012-2013;

  • section 10 of Appropriation Act (No. 1) 2011-2012;

  • section 11 of Appropriation Act (No. 1) 2011-2012;

  • section 13 of Appropriation Act (No. 2) 2011-2012;

  • section 10 of Appropriation Act (No. 5) 2011-2012.

  1. Name of Instrument

This is the Instrument to Reduce Appropriations (No. 1 of 2013‑2014).

  1. Commencement

This Instrument commences on the day it is registered.

Note      Section 42 (disallowance) of the Legislative Instruments Act 2003 applies to this Instrument (despite subsection 44(2) of that Act which exempts certain legislative instruments from disallowance).
However, Part 6 (sunsetting) of the Legislative Instruments Act 2003 does not apply to this Instrument. 

  1. Determinations

(1) For the purposes of subsection 10(2) of Appropriation Act (No. 1) 2012-2013, it is determined that the departmental items for the agencies specified in column 1 of Schedule 1 to this Instrument are reduced by the amounts specified in column 2 of that Schedule.

(2) For the purposes of subsection 12(2) of Appropriation Act (No. 1) 2012-2013, it is determined that the CAC Act body payment items for the bodies specified in column 1 of Schedule 2 to this Instrument are reduced by the amounts specified in column 2 of that Schedule.

(3) For the purposes of subsection 13(2) of Appropriation Act (No. 2) 2012-2013, it is determined that the administered assets and liabilities items for the agencies specified in column 1 of Schedule 3 to this Instrument are reduced by the amounts specified in column 2 of that Schedule.

(4) For the purposes of subsection 13(2) of Appropriation Act (No. 2) 2012-2013, it is determined that the other departmental items (Equity Injections) for the agencies specified in column 1 of Schedule 4 to this Instrument are reduced by the amounts specified in column 2 of that Schedule.

(5) For the purposes of subsection 11(2) of Appropriation (Parliamentary Departments) Act (No. 1) 2012‑2013, it is determined that the departmental items for the agencies specified in column 1 of Schedule 5 to this Instrument are reduced by the amounts specified in column 2 of that Schedule.

(6) For the purposes of subsection 13(2) of Appropriation Act (No. 4) 2012-2013, it is determined that the administered assets and liabilities item for the agency specified in column 1 of Schedule 6 to this Instrument is reduced by the amount specified in column 2 of that Schedule.

(7) For the purposes of subsection 13(2) of Appropriation Act (No. 4) 2012-2013, it is determined that the other departmental item (Equity Injections) for the agency specified in column 1 of Schedule 7 to this Instrument is reduced by the amount specified in column 2 of that Schedule.

(8) For the purposes of subsection 10(2) of Appropriation Act (No. 1) 2011-2012, it is determined that the departmental items for the agencies specified in column 1 of Schedule 8 to this Instrument are reduced by the amounts specified in column 2 of that Schedule.

(9) For the purposes of paragraph 11(2)(a) of Appropriation Act (No. 1) 2011-2012, it is determined that subsection 11(1) of that Act applies in relation to the administered items specified in column 1 of Schedule 9 to this Instrument for the agencies specified in column 2 of that Schedule as if the amounts specified in the 2011-2012 annual reports of those agencies in respect of those items were the amounts specified in column 3 of that Schedule.

(10) For the purposes of subsection 13(2) of Appropriation Act (No. 2) 2011-2012, it is determined that the other departmental item (Equity Injections) for the agency specified in column 1 of Schedule 10 to this Instrument is reduced by the amount specified in column 2 of that Schedule.

(11) For the purposes of subsection 10(2) of Appropriation Act (No. 5) 2011-2012, it is determined that the departmental item for the agency specified in column 1 of Schedule 11 to this Instrument is reduced by the amount specified in column 2 of that Schedule.

Note         The eleven Schedules of this Instrument reduce excess appropriations by $760,744,020.14. The breakdown of amounts reduced by each Schedule is available in the Explanatory Statement to this Instrument.
