Her Excellency the Governor, with the advice of the Executive Council, has made the following

Regulation under the Institute of Teachers Act 2004.

Explanatory note
The object of this Regulation is to amend the Institute of Teachers Regulation 2010 as a consequence of the amendments made to the Institute of Teachers Act 2004 by the Board of Studies, Teaching and Educational Standards Act 2013. Those amendments rename the Institute of Teachers Act 2004 as the Teacher Accreditation Act 2004 and replace the NSW Institute of Teachers with the Board of Studies, Teaching and Educational Standards.

This Regulation also updates definitions relating to rural and non-rural areas for the purposes of electing regulation-making power).

1      Name of Regulation

This Regulation is the Institute of Teachers Amendment Regulation 2013.

2      Commencement

This Regulation commences on 1 January 2014 and is required to be published on the
NSW legislation website.

Schedule 1 Amendment of Institute of Teachers Regulation
2010

[1]      Clause 1 Name of Regulation

Omit “Institute of Teachers Regulation 2010”.
Insert instead “Teacher Accreditation Regulation 2010”.

[2]      Clause 3 Definitions

Insert in alphabetical order in clause 3 (1):

Chief Executive means the Chief Executive of the Office of the Board of
Studies, Teaching and Educational Standards.

[3]      Clause 3 (1), definition of “the Act”

Omit “Institute of Teachers”. Insert instead “Teacher Accreditation”.

[4]      Clauses 5, 10, 12 (1) (c), 36, 37 (2), 39, 70, 71 (g) and (i) and 73

Omit “Institute” wherever occurring. Insert instead “Board”.

[5]      Clause 13 Definitions

Omit the definitions of non-rural area and rural area. Insert instead:

non-rural area means a part of the State that is not a rural area.
rural area means a part of the State that is within any of the following school

groupings designated by the Department of Education and Communities:

(a) Hunter/Central Coast (excluding the Callaghan/Port Stephens, Lake Macquarie East, Lake Macquarie West and Newcastle principal networks),
(b) Illawarra and South Coast (excluding the Wollongong and Wollongong North principal networks),
(c) New England, North Coast, Riverina and Western NSW.

[6]      Clause 24 Qualifications to be nominated

Omit “(whether an elected member, an appointed member or the chairperson)” from clause 24 (1) (b).

[7]      Clause 37 Delivery of electoral list

Omit “Officer” from clause 37 (3).

[8]      Clause 71 Eligibility to be enrolled

Omit clause 71 (h).

[9]      Clause 72 Exchange of information

Omit the clause.

[10]      Schedule 1 Forms

Omit “Institute of Teachers Act 2004” wherever occurring.
Insert instead “Teacher Accreditation Act 2004”.
