Regulation 2009

Institute of Teachers Act 2004

Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Institute of Teachers Act 2004.

Explanatory note
The Institute of Teachers Act 2004 provides that a person who:

(a)

immediately before the relevant date was the holder of a tertiary or teaching qualification, and

(b)

after that date, returns to teaching after a break from the classroom of more than 5 years,

The object of this Regulation is to prescribe 1 July 2009 as the relevant date in respect of those
new scheme teachers.
This Regulation is made as a consequence of the enactment of the Institute of Teachers
Amendment Act 2009.

1      Name of Regulation

This Regulation is the Institute of Teachers Amendment Regulation
2009.

2      Commencement

This Regulation commences on 1 July 2009 and is required to be published on the NSW legislation website.

3 Amendment of Institute of Teachers Regulation 2005

Insert after clause 10:

10A Definition of “relevant date”

For the purposes of the definition of relevant date in section 28 of the Act, 1 July 2009 is prescribed in respect of new scheme teachers referred to in paragraph (d) of the definition of new scheme teacher in that section and is so prescribed in respect of all of the provisions of Division 3 of Part 4 of the Act.
