Institute of Teachers Amendment

(Quality Teaching Council) Regulation

2011

Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Institute of Teachers Act 2004.

Explanatory note
The objects of this Regulation are as follows:

(a)

to make it clear that the requirement in the Institute of Teachers Act 2004 (the Act) that elected members of the Quality Teaching Council be teachers accredited under Part 4 of the Act from 28 November 2011 applies only to members elected after that date,

(b)

to provide an exemption from the requirement in the Act that appointed members of the Quality Teaching Council hold office for terms totalling not more than 6 years (but only in relation to current appointed members and only to the extent that the member holds office for terms totalling not more than 7 years).

This Regulation is made under the Institute of Teachers Act 2004, including clause 1 (1) of

Schedule 3 and section 52 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Institute of Teachers Amendment (Quality
Teaching Council) Regulation 2011.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

3 Amendment of Institute of Teachers Regulation 2010

(1) Clause 12A

Insert after clause 12:

12A Application of section 13 (3) of the Act (requirement that
elected members be accredited teachers from certain date)

Section 13 (3) of the Act applies only in relation to an elected member who is elected after the sixth anniversary of the first election of the elected members of the Council.

(2) Clause 72A
Insert after clause 72:
72A Exemption from requirement that appointed members hold
office for not more than 6 years
(1) A person who is an appointed member of the Council on the relevant date is exempt from the operation of section 13 (4) of the Act but only to the extent that the appointed member holds office for terms totalling not more than 7 years.

(2) In this clause, relevant date means the date of commencement of the Institute of Teachers Amendment (Quality Teaching Council) Regulation 2011.
