1Name

This instrument is the Inspector-General of Aged Care Regulations 2023.

2Commencement

1. (1)

   Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3Authority

This instrument is made under the Inspector‑General of Aged Care Act 2023.

4Definitions

In this instrument:

Act means the Inspector‑General of Aged Care Act 2023.

5Remuneration and allowances of Inspector‑General

General

1. (1)

   For the purposes of subsections 34(1) and (2) of the Act, the Inspector‑General is to be paid the same remuneration and allowances the Inspector‑General would be paid if:

   1. (a)

      a reference in the Remuneration Tribunal (Remuneration and Allowances for Holders of Full‑time Public Office) Determination (No. 1) 2023, as in force at the commencement of this instrument, to an office holder included a reference to the Inspector‑General; and

   2. (b)

      Table 2A in section 10 of that instrument included:

      1. (i)

         a reference in column 1 to the office of Inspector‑General; and

      2. (ii)

         a reference in column 2 to a total remuneration (per year) of $427,120 for that office.

Official travel

1. (2)

   For the purposes of subsection 34(2) of the Act, the Inspector‑General is also to be paid the same allowances in relation to travel for business pertaining to or required by the duties of the office that the Inspector‑General would be paid if:

   1. (a)

      a reference in Parts 4, 5 and 6 of the Remuneration Tribunal (Official Travel) Determination 2023, as in force at the commencement of this instrument, to an office holder included a reference to the Inspector‑General; and

   2. (b)

      the travel tier specified for the Inspector‑General for the purposes of that instrument was tier 2.

6Documents and information to accompany request for protection of disclosure

For the purposes of paragraph 54(2)(d) of the Act, the documents and information that must accompany a request by an individual that identifying information about the individual be protected as confidential are the following:

1. (a)

   documents or information that provide proof of the individual’s identity;

2. (b)

   a statement by the individual that describes:

   1. (i)

      the nature of the detriment that the individual believes would, or is likely to, result to the individual if identifying information about the individual is disclosed; and

   2. (ii)

      the reasons why the individual believes that detriment would, or is likely to, result;

3. (c)

   documents or information providing evidence of the circumstances of the individual that are relevant to the statement (for example, evidence of the individual’s employment if the detriment is related to that employment).
