B E it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legis lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:— 1. (1.) This Act may be cited as “ The Inspection Short titIe- of Scaffolding Acts Amendment Act of 1955.” (2.) *“ The Inspection of Scaffolding Acts, 1915 to ^lcipal 1954,” are in this Act referred to as the Principal Act. ° ‘ (3.) The Principal Act and this Act may be Collective collectively cited as “ The Inspection of Scaffolding Acts, tltle‘ 1915 to 1955.” 2. The following section, numbered 10 a , is insertedNew s- 10a- after section ten of the Principal Act:— “ [10 a .] Without limiting the provisions of sections inspector eight and ten of this Act, any inspector who— r^"ire (i.) Finds any person committing or whoaddress' reasonably suspects any person of having committed an offence against this Act; or (ii.) Is making investigations or inquiries with a view to establishing whether or not an offence against this Act has been committed by any person ; or (iii.) Questions, with respect to matters under this Act, any person, may require such person to state his name and address or name or address and, if he has reasonable grounds to suppose that the name and address, or name or address, given is false, may require evidence of the correctness thereof. Any person required under this section— (a) To state his name and address or name or address who fails to state his name and address or, as the case may be, name or * 6 G. 5 No. 25 and amending Acts.

No. 3, 1955. address, or states a false name and address or, as the case may be, a false name or false address ; (b) To give evidence of the correctness of his name and address, or name or address, who fails to give that evidence or who gives false evidence with respect to his name and address or, as the case may be, name or address, shall be guilty of an offence against this Act.”. Amendments Of 8. 11. 3. Section eleven of the Principal Act is amended— (i.) By repealing in subsection one thereof the words “ of the description prescribed by the regulations ” and by inserting, in lieu of those repealed words, the words “ either of a description prescribed by the regulations or of a description approved by the Chief Inspector ” ; (ii.) By repealing in subsection two thereof the words “, without the prior approval in writing of the Chief Inspector ” ; (iii.) By inserting in subsection two thereof after the words “ prescribed by the regulations ” the words “ or of a description approved by the Chief Inspector ”; and (iv.) By adding thereto the following subsections “ (3.) An inspector may seize any scaffolding or gear or any part of any scaffolding or gear which is neither of a description prescribed by the regulations nor of a description approved by the Chief Inspector. (4.) Anything seized under this section shall be deemed to be forfeited to Her Majesty and shall be dealt with as directed by the Chief Inspector. (5.) In any proceedings under, or resulting from the administration of, this section evidence by any inspector that any scaffolding or gear or any part of any scaffolding or gear is not of a description approved by the Chief Inspector shall be received and in the absence of evidence in rebuttal thereof shall be conclusive evidence thereof.”.

By repealing paragraph ( b) of subsection one thereof and by inserting, in lieu of that repealed paragraph, the following paragraph :— “ ( b ) In writing, order the owner thereof— (i.) To destroy the scaffolding or gear or part of the scaffolding or gear in question ; or (ii.) To do such acts or things to such scaffolding or gear or part as will m the inspector’s opinion make such scaffolding, gear, or part either safe for the purposes for which it is intended to be used or incapable of further use.” ; and (ii.) By repealing subsection two thereof. An Act to Amend “ The Wages Acts, 1918 to 1937,” 3 |0LIZ24H- in a certain particular. (1.) This Act may be cited as “ The Wages Acts Short title. Amendment Act of 1954.” (2.) *“ The Wages Acts, 1918 to 1937,” are in this Act Principal referred to as the Principal Act. *c' (3.) The Principal Act and this Act may be Coiiectiv collectively cited as “ The Wages Acts, 1918 to 1954.” tlt6, 2. Section three of the Principal Act is amended Amendment by repealing subparagraph ( d ) of the definition of the ° s’ ‘ term “ Wages * 9 G. 5 No. 19 and amending Acts.
