67 Qu e ensla « a AT NO DUODECIMO ELIZABETHAE SEC UNDAE REGINAE No. 17 of 1963 An Act to Amend " The Inspection of Machinery Acts, 1951 to 1960 ," in certain particulars ASSENTED TO 3RD DECEMBER, 1963] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. (1) Short title. This Act may be cited as " The Inspection of Machinery Acts Amendment Act of 1963." (2) Principal Act. " The Inspection of Machinery Acts, 1951 to 1960," are in this Act referred to as the Principal Act. (3) Collective title. The Principal Act and this Act may be collectively cited as " The Inspection of Machinery Acts, 1951 to 1963." 2. Amendments of s. 7. Section seven of the Principal Act is amended by- (a) omitting the definition " Crane " and inserting in its stead the following definition: " " Crane "-A specially designed structure equipped with mechanical means for moving a load by raising or lowering or raising and lowering and, whilst the load is in such state
68 Inspection of Machinery Acts Amendment Act of 1963, No. 17 of motion or suspension , transporting it, and shal l include cranes of the following types:-bridge or gantry crane, cantilever crane , jib crane , cableway, overhead travelling crane , portal and semi-portal crane, tower crane, stiff leg derrick , monorail crane , sheer legs , or guy derrick;"; (b) omitting the definition " Hoist " and inserting in its stead the following definition: " " Hoist "-Any machinery , including all equipment thereof whether detachable therefrom or not ( other than a crane or lift and other than a builder ' s hoist as defined in "The Inspection of Scaffolding Acts , 1915 to 1963 ") operated by any power including hand, foot , or animal power the principal function of which is raising or lowering of men, or goods or materials;"; (c) inserting after the definition " Serious bodily injury " the following definition: " "Slinger "-A person slinging and directing the movement of loads handled by a crane in factories and workshops where such loads are usually in full view of the crane driver;". 3. Amendment of s. 15 (6). Subsection (6) of section fifteen of the Principal Act is amended by adding to the proviso thereto the following paragraph :- "; or (vii.) Any automated machinery controlled to the satisfaction of the Chief Inspector." 4. Repeal of and new s. 55. The Principal Act is amended by repealing section fifty-five and inserting in its stead the following section:- " [55.] Classes or grades of certificates of competency . Subject to this Act, the Board shall have power to grant the following certificates of competency:- 1. Engineer's certificate; 2. First class engine driver's certificate; 3. Second class engineer 's certificate; 4. Second class engine driver's certificate; 5. Third class engine driver's certificate; 6. First class boiler attendant's certificate; 7. Second class boiler attendant's certificate; 8. Third class boiler attendant's certificate; 9. Fourth class boiler attendant's certificate; 10. Steam locomotive driver's certificate; 11. Oil locomotive driver's certificate; 12. First class crane driver's certificate; 13. Second class crane driver's certificate; 14. First class internal combustion certificate; 15. Second class internal combustion certificate;

First class plant operator's certificate; 20. Second class plant operator's certificate; 21. Third class plant operator's certificate; 22. "A" Grade motor mechanic's certificate; 23. " B " Grade motor mechanic's certificate; 24. Any other prescribed certificate." 5. Amendments of Schedule IT. The Second Schedule to the Principal Act is amended by- (a) adding to rule 2 the following paragraphs- (g) A holder of a certificate of acknowledgment of service from a recognised railway authority proving twelve months' service as a steam locomotive driver-a steam locomotive driver's certificate; (h) A holder of a certificate of acknowledgment of service from a recognised railway authority proving twelve months' service as an oil locomotive driver-an oil locomotive driver's certificate; (i) A holder of a certificate of acknowledgment of service from a recognised railway authority proving not less than two years' service as a steam locomotive fireman-a third class boiler attendant's certificate."; (b) in rule 3 adding to the paragraph beginning with the words " To the holder of a certificate as a second-class marine engineer " the words " or a second class engineer's certificate "; (c) in sub-rule (3) of rule 7 inserting after the words " or first class engine driver's " the words " or locomotive driver's or first class crane driver's "; (d) omitting rule 8 and inserting in its stead the following rule :- " 8. Qualifications for engineer ' s certificate . (1.) An applicant for an engineer's certificate- (a) Shall have worked as an apprentice or tradesman for at least five years in a workshop or workshops where machinery is manufactured or repaired or manufactured and repaired and in the course of such work shall have had experience to the satisfaction of the Board and in addition shall have been the holder of a second class engineer's certificate for a period of at least twelve months and since the granting of that certificate- (i.) Shall have been in charge of machinery and boilers the required authority for taking charge of which is a second class engineer's certificate, for a period of at least two thousand hours; or (ii.) Shall have been assisting the engineer in charge of machinery the required authority for taking charge of which is an engineer's or first class engine driver's certificate for a period of at least two thousand hours; or
70 Inspection of Machinery Acts Amendment Act of 1963, No. 17 (b) Shall have been the holder of a second class engineer's certificate for a period of at least two years and since the granting of that certificate shall have been continuously employed in the operation , maintenance and repair of machinery the required authority for taking charge of which is an engineer ' s or first class engine driver ' s certificate , and shall produce evidence that during this period he has assisted in the operation of steam engines and boilers the required authority for taking charge of which is an engineer's or first class engine driver ' s certificate for the period of at least five hundred hours; or (c) Shall have had charge outside Queensland or on board ship of machinery the required authority for taking charge of which, in Queensland is an engineer ' s or first class engine driver's certificate for the period of at least two thousand hours; or (d) Shall have worked outside Queensland or on board ship actually assisting the person in charge of machinery , the required authority for taking charge of which in Queensland is an engineer ' s or first class engine driver's certificate , for the period of at least two thousand hours; or (e) Shall have been the holder of a first class engine driver's certificate for at least five years and shall have been during that time in charge of machinery, the required authority for taking charge of which is a first class engine driver' s certificate, and shall have had experience for at least two and a-half years in the installation , maintenance and repair of machinery the required authority for taking charge of which is a first or second class engine driver ' s certificate. (2.) An applicant for an engineer's certificate authorising him to drive and have charge of internal combustion engines or refrigeration machinery, or both internal combustion engines and refrigeration machinery shall, additionally to complying with the requirements of sub-rule (1.) of this rule, have had experience adequate, having regard to his application, to the satisfaction of the Board, of internal combustion engines, or refrigeration machinery , or both internal combustion engines and refrigeration machinery. (3.) An applicant may, notwithstanding that he cannot comply with the requirements of paragraphs (a) or (b) of sub-rule (1.) of this rule, apply for and be granted an engineer's certificate the authority of which limits him to driving and being in charge of refrigeration machinery, if he- (a) Has been the holder of a second class engineer's certificate for at least two years and during that time has been, to the satisfaction of the Board , continuously employed in the operation , maintenance and repair of refrigeration machinery; and (b) Produces evidence to the satisfaction of the Board that since the granting of such certificate- (i.) The period of such employment during which he assisted in the operation of refrigeration machinery, the required certificate for taking charge of which is a first class refrigeration certificate, was at least five hundred hours; and (ii.) The period of such employment during which he assisted in the operation of steam boilers was at least one hundred and fifty hours.
Inspection of Machinery Acts Amendment Act of 1963, No. 17 71 (4.) An applicant for a second class engineer 's certificate shall- (a) Have worked as an apprentice or tradesman for at least five years in a workshop or workshops where machinery is manufactured or repaired or manufactured and repaired and in the course of such work have had experience to the satisfaction of the Board ; or (b) Be the holder of a degree in engineering from a recognised university, or a diploma in engineering from a technical college, and have had in addition at least sixteen months' experience in a workshop in which machinery is manufactured or repaired or manufactured and repaired, and in either case shall produce evidence to the satisfaction of the Board that he has had at least eighty hours' experience in the working of steam boilers."; (e) omitting rule 11 and inserting in its stead the following rule:- " 11. Qualifications for locomotive driver's certificate . (1.) An applicant for a steam locomotive driver's certificate- (a) Shall have had at least one thousand hours' experience under a certificated person in the operation of steam locomotives; or (b) Shall be the holder of an oil locomotive driver's certificate and since the granting of such certificate shall have had at least five hundred hours' experience under a certificated person in the operation of steam locomotives. (2.) An applicant for an oil locomotive driver's certificate- (a) Shall have had at least five hundred hours' experience under a certificated person in the operation of oil locomotives; or (b) Shall be the holder of a steam locomotive driver's certificate and since the granting of such certificate shall have had at least one hundred hours' experience under a certificated person in the operation of oil locomotives."; (f) omitting rule 13 and inserting in its stead the following rule:- " 13. Qualifications for first class crane driver ' s certificate. An applicant for a first class crane driver's certificate- (a) Shall have had at least two hundred hours' experience under a certificated person in the operation of a power operated jib crane , portal or semi-portal crane, tower crane, cableway, or such other power operated crane as may be determined by the Chief Inspector; (b) Shall be the holder of a second class crane driver's certificate and since the granting of that certificate shall have had at least one hundred and fifty hours' experience under a certificated person in the operation of cranes the required authority for taking charge of which is a first class crane driver's certificate; or (c) Shall be the holder of a general or electrical winding license granted under the provisions of " The Mines Regulation Acts, 1910 to 1958," or " The Coal Mining Acts, 1925 to 1952 "."; (g) omitting rule 14 and inserting in its stead the following rule:- " 14. Qualifications for second class crane driver's certificate. An applicant for a second class crane driver's certificate shall have had at least one hundred hours' experience under a certificated person in the operation of a power operated overhead travelling crane, gantry crane, or such other crane as may be determined by the Chief Inspector.";
72 Inspection of Machinery Acts Amendment Act of 1963, No. 17 (h) inserting after rule 14 the following rule:- " 14A. Qualifications for a slinger ' s certificate . An applicant for a slinger's certificate shall prove to the satisfaction of the Chief Inspector by oral and practical examination or by documentary evidence that he has- (a) at least three months' experience in making up slinging and directing the movement of loads; (b) a knowledge of the measures to be taken to prevent accidents in connection with the movement of loads by a crane; (c) a knowledge of the safe methods of slinging and handling loads; (d) a knowledge of the safe working loads of ropes and chain slings and their fittings; and (e) a knowledge of crane signal codes." (i) in sub-rule (2) of rule 16 omitting the words " five tons " and inserting in their stead the words " ten tons "; (j) in rule 18- (i.) omitting sub-rule (4) and inserting in its stead the following sub-rule:- " (4.) (a) Steam locomotive driver ' s certificate . A steam locomotive driver's certificate shall entitle the holder thereof to drive and have charge of any steam locomotive and of its boiler propelled or moved from place to place by its motive power or machinery, and of any stationary . steam engine or steam engines and of its or their boilers the required authority for taking charge of which is a third class engine driver's certificate as by this Act prescribed. (b) Oil locomotive driver ' s certificate . An oil locomotive driver's certificate shall entitle the holder thereof to drive and have charge of any oil driven locomotive propelled or moved from place to place by its motive power or machinery."; (ii.) omitting sub-rules (10) and (11) and inserting in their stead the following sub-rules:- " (10.) First class crane driver ' s certificate . A first class crane driver's certificate shall authorise the holder thereof to take charge of any power operated crane as defined by this Act, with the exception that to operate steam driven cranes he shall also hold a steam engine driver's certificate of the required class issued under this Act. (11.) Second class crane driver ' s certificate . A second class crane driver's certificate shall authorise the holder thereof to take charge of any power operated cab controlled overhead travelling crane or gantry crane or any floor controlled overhead travelling crane exceeding 5 tons capacity or such other crane or hoist as may be determined by the Chief Inspector."; (iii.) inserting after sub-rule (11) the following sub-rule:- "(I IA.) Slinger ' s certificate . A slinger's certificate shall authorise the holder thereof to make up, sling and direct the movement of loads handled by a power crane in factories and workshops, where such loads are usually in full view of the crane driver and where such loads while suspended are transported.";

An engineer's certificate limited to refrigeration machinery shall authorise the holder to take charge of any refrigeration machinery and any boiler or boilers the area or aggregate area of heating surface of which does not exceed five thousand square feet of heating surface."; and (k) in rule 20- (i.) omitting the words "a crane driver's certificate or a hoist driver's certificate ", where appearing in sub-rule (1), and inserting in their stead the words " a first class crane driver's certificate or a second class crane driver's certificate "; (ii.) omitting the words " a crane driver's certificate or a hoist driver's certificate or other certificate ", where appearing in sub-rule (2), and inserting in their stead the words " a first class crane driver's certificate, a second class crane driver's certificate or other certificate "; and (iii.) omitting the words " the crane driver's certificate, hoist driver's certificate or other certificate ", where appearing in sub-rule (2), and inserting in their stead the words " the first class crane driver's certificate, second class crane driver's certificate or other certificate ".
