INSPECTION OF MACHINERY

(No. 2).

No. 67 of 1969.

AN ACT to amend the Inspection of Machinery

Act, 1921-1969.

[Assented to 27th October, 1969.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Inspection gargiggaon.

2. Section 15 of the principal Act is amended

(a)

by repealing subsection (3) and re-enact- ing it as follows

(3) No boiler shall at any time be left in charge of any person of less than eighteen years of age. ; and

(b)

by adding after subsection (3) a subsection as follows

(3a) No boiler of six-horse power or more shall at any time be left in charge of any female person. .

3. Section 36 of the principal Act is amended

(a)

by adding after the section number "36." the subsection designation "(1)"; and

(b)

by adding a subsection as follows

(2) Notwithstanding the provisions of subsection (1) of this section the Governor may, on the recommendation of the Minister, declare to be exempt from inspection fees any boiler, winding- engine as defined, or any group of machinery driven otherwise than by steam that the Minister considers is owned by a charitable institution or organisation or is used solely for the purpose of education or instruction. .

Subsection (4) of section 53 of the principal Act is amended by substituting for the passage "subparagraph (iii)", in lines one and two, the passage "subparagraph (ii)".

Section 56 of the principal Act is amended

(a)

by adding after the word "inches", in line six of subsection (3), the words "and of any steam turbine with a shaft horse- power not exceeding seven hundred and Iffy" ;

(b)

by adding after the word "engines", in line seven of subsection (3), the passage ", turbines," ;

(c)

by adding after the word "inches", in line six of subsection (4), the words "and of any steam turbine with a shaft horse- power not exceeding one hundred and fifty" ; and

(d)

by adding after the word "boilers", in line six of subsection (4), the passage "where the engines, turbines, and boilers are so situated that the Chief Inspector or his representative is satisfied the engine- driver can efficiently discharge his duties without danger to the engines, turbines, and boilers" .

6.    Section 58 of the principal Act is amended by =rent

repealing subsection (2) and re-enacting it as

follows:—

(2) The Board shall conduct examinations for certificates of competency but where they are for boiler attendants' and crane and hoist drivers' certificates the Board may appoint a person or persons to conduct the examinations on behalf of the Board. .

7.    Section 59 of the principal Act is amended— =tent

(a)

by repealing subsection (2) and re-enact- ing it as follows:

(2) Every applicant for a certificate of competency under this Act shall, before the certificate is granted to him, satisfy the Board that his knowledge of the English language is sufficient to enable him to perform the duties required of the holder of such a certifi- cate. ; and

(b) by repealing subsection (2a).

8. Section 63 of the principal Act is amended

(a)

by adding after the word "certificate", in line two of paragraph (a), the passage "(steam)" ;

(b)

by adding after paragraph (a) a paragraph as follows:—

(aa) To the holder of a first-class or second-class marine engineer's certificate (motor)—an internal combustion engine driver's certifi- cate. ; and

(0) by adding after the word "certificate", in

line two of paragraph (b), the passage

"(steam)".
