fore enac ted by t h e Queen ' s Mos t Exce l len t Majesty by a n d wi th t h e

advice a n d consent of t h e Legis la t ive Counci l a n d Legis la t ive

Assembly of N e w South W a l e s in Pa r l i amen t	assembled	and	by	t h e
au tho r i t y of t he same as follows :—

1 . The Chief Commissioner of Inso lven t Es ta t e s shall hold his

office du r ing abil i ty and good behaviour and shall be paid a n a n n u a l

sa lary n o t less t h a n t h e s u m of one t h o u s a n d pounds B u t i t shal l be

lawful for t h e Governor w i t h t h e advice of t h e Execu t ive Counci l to

shall thereaf ter and before removal have t h e oppor tun i ty of being- heard before t he Governor and Execu t ive Council in his defence Provided t h a t if t h e office of Chief Commissioner should be abolished by any A c t of t he Pa r l i amen t no such Chief Commissioner shall be ent i t led to any compensat ion on account of ceasing to hold his office.

2. N o person shal l be appointed as such Chief Commissioner

unless he shal l be a Bar r i s te r -a t - law of five years or a n A t t o r n e y - a t -

law of seven years s tand ing .
3 . I n case of illness or absence of t h e Chief Commissioner it
shall be lawful for t he Governor w i th t he advice aforesaid to appoin t

some fit person to act as D e p u t y for t h e said Chief Commissioner w i th

all t he ju r i sd ic t ion powers au thor i t ies and duties of	such	Chief
Commissioner .

4. This Ac t shall be styled and may be cited as t h e " Insolvency

Commissioner ' s Act of 1861. "
