Inland Fisheries Amendment Regulations 1999
I, the Lieutenant-Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Inland Fisheries Act 1995 .29 July 1999

1Short titleThese regulations may be cited as the Inland Fisheries Amendment Regulations 1999 . 2CommencementThese regulations take effect on 31 July 1999. 3Principal RegulationsIn these regulations, the Inland Fisheries Regulations 1996 are referred to as the Principal Regulations. 4Regulation 3 amended (Interpretation) Regulation 3 of the Principal Regulations is amended as follows: (a) by omitting the definitions of bank and artificial fly and substituting the following definitions: artificial fly means a representation of any fly, insect, small organism or fish that – (a) is made from feather, fur, wool, silk, synthetic or similar material; and (b) is affixed to a single hook; and (c) does not incorporate any lead or other weight to facilitate casting; and (d) does not incorporate any device to impart a rotary or darting motion; bank, in relation to inland waters, includes land within 100 metres of – (a) the bank of a river; or (b) the edge or high-water mark of the inland waters; (b) by inserting the following definitions after the definition of mesh : Middle Myrtle Pond means the middle pond of the 3 ponds situated on the eastern side of the Mersey River in the Warrawee Forest Reserve, excluding the channel flowing into that pond; mud eye means an insect of the suborder Anisoptera of the order Odonata; 5Regulation 7 amended (Use of equipment) Regulation 7 of the Principal Regulations is amended as follows: (a) by omitting from subregulation (1)(b) "time." and substituting "time; or"; (b) by inserting the following paragraphs after paragraph (b) in subregulation (1) : (c) more than 3 artificial flies on a line at a time; or (d) 2 lures or 2 baits together with one or more artificial flies. (c) by omitting from subregulation (2A)(b)(i) "time" and substituting "time, unless the person is fishing in Middle Myrtle Pond". 6Regulation 8 substituted Regulation 8 of the Principal Regulations is rescinded and the following regulation is substituted: 8Use of other equipment (1) A person, while fishing, must not – (a) when using his or her rod and line, have possession of another person’s rod and line; or (b) use a bottle, jar, can or similar object made of plastic, glass or metal in conjunction with a rod or line to warn of movement in the rod and line. Penalty: Fine of not less than 1 penalty unit and not more than 5 penalty units.
(2) A person fishing in Middle Myrtle Pond must not take any fish while that person is floating with the aid of any device, equipment or apparatus that provides buoyancy.Penalty: Fine of not less than 1 penalty unit and not more than 5 penalty units.
7Regulation 12 amended (Minimum sizes of fish) Regulation 12 of the Principal Regulations is amended as follows: (a) by omitting from subregulation (1)(e) "230 millimetres" and substituting "250 millimetres"; (b) by inserting in subregulation (3) "and bream" after "crayfish"; (c) by inserting the following subregulation after subregulation (4) : (4A) The length of bream is to be measured from the forwardmost point of the fish to the end of the tail. 8Regulation 13 amended (Bag limits) Regulation 13(1A) of the Principal Regulations is amended as follows: (a) by omitting paragraph (a) and substituting the following paragraphs: (a) Four Springs Lake, 5 salmon; (aa) Lagoon of Islands, 3 salmon; (b) by inserting the following paragraph after paragraph (g) : (ga) Middle Myrtle Pond, 2 salmon; 9Regulation 16 amended (Taking fish from boats) Regulation 16(4) of the Principal Regulations is amended as follows: (a) by omitting from paragraph (d) "Bay." and substituting "Bay; or"; (b) by inserting the following paragraph after paragraph (d) : (e) in Middle Myrtle Pond. 10Regulation 18 amended (Use of baits and lures) Regulation 18(4A) of the Principal Regulations is amended by inserting ", other than mud eye," after "a fish". 11Schedule 3 amended (Fees)Schedule 3 to the Principal Regulations is amended by omitting item 7 from Part 1 and substituting: 7. | Fish farm licence – commercial scale 2 (flow through water) |
