Infringements (Reporting and Prescribed Details and Forms) Amendment Regulations 2008

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Infringements (Reporting and Prescribed Details and Forms) Regulations 2006 to amend the details that must be contained in an infringement notice and a penalty reminder notice.

2Authorising provision

These Regulations are made under section 168 of the Infringements Act 2006.

3Definitions

In regulation 4 of the Infringements (Reporting and Prescribed Details and Forms) Regulations 2006[1]—

(a)in the definition of the Act, for "2006." substitute "2006;";

(b)insert the following definitions—

"Toll Enforcement Office means the body specified in item 2(b) of Schedule 1 to the Infringements (General) Regulations 2006 as an enforcement agency;

Traffic Camera Office means the body specified in item 2(c) of Schedule 1 to the Infringements (General) Regulations 2006 as an enforcement agency.".

4Infringement notice

In regulation 8(1) of the Infringements (Reporting and Prescribed Details and Forms) Regulations 2006—

(a)in paragraph (f), before "either" insert "subject to paragraph (fa),";

(b)after paragraph (f) insert—

"(fa)in the case of an infringement notice issued or served on behalf of the Traffic Camera Office or the Toll Enforcement Office, the title or name of the issuing officer;".

5Penalty reminder notice

In regulation 11 of the Infringements (Reporting and Prescribed Details and Forms) Regulations 2006—

(a)in paragraph (f), before "either" insert "subject to paragraph (fa),";

(b)after paragraph (f) insert—

"(fa)in the case of a penalty reminder notice issued or served on behalf of the Traffic Camera Office or the Toll Enforcement Office, the title or name of the issuing officer;".
