Infringements (General) Further Amendment Regulations 2014

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Infringements (General) Regulations 2006 to prescribe certain infringement offences under the Estate Agents Act 1980, the Mineral Resources (Sustainable Development) Act 1990, the Motor Car Traders Act 1986, the Road Safety Act 1986 and the Sale of Land Act 1962 as lodgeable infringement offences for the purpose of enforcement under the Infringements Act 2006.

2Authorising provision

These Regulations are made under section 168 of the Infringements Act 2006.

3Commencement

(1)These Regulations (except for regulations 7 and 8) come into operation on the day on which they are made.

(2)Regulation 7 comes into operation on 1 November 2014.

(3)Regulation 8 comes into operation on 3 November 2014.

4Principal Regulations

In these Regulations, the Infringements (General) Regulations 2006[1] are called the Principal Regulations.

5Lodgeable infringement offences—item 2 of Schedule 3 substituted

For item 2 of Schedule 3 to the Principal Regulations substitute—

"2 Estate Agents Act 1980

2.1Sections 16(7), 21B(2), 29A(1), 30A(1), 41(1), 41(2), 42(1), 43(1), 47(2), 47(2A), 47A(1), 47D(3), 48(2), 48A(2), 49A(2), 59(7), 63(3), 63(3B), 63(5)(a), 63(5)(b), 64(1), 64(1A), 64(2A), 64(3), 64(9), 64(13), 64B(1)(a), 64B(1)(b), 69(1B), 70B and 98A(1).

2.2Regulations 5(1), 5(2), 5(4), 6, 10, 11(2), 12(1), 13(1), 13(2), 13(3), 13(4), 14(8), 15(8), 16(2), 16(3), 17(1), 18(1), 18(2), 18(4), 18(5), 19(1), 19(3), 19(4), 20, 21(1), 22(1), 22(2), 23(1), 23(3), 23(4), 23(5), 23(6), 23(7), 23(8), 24(2), 24(4), 25(1), 26(1), 26(2), 29(2), 29(3), 29(5) and 30(1) of the Estate Agents (General, Accounts and Audit) Regulations 2008.".

6Lodgeable infringement offences—Road Safety Act 1986

(1)In item 9A.5 of Schedule 3 to the Principal Regulations after "197(1A)," insert "197(1B),".

(2)In item 9A.9 of Schedule 3 to the Principal Regulations—

(a)after "58(1)(b)," insert "58(1A)(a), 58(1A)(b), 58(1A)(c),";

(b)after "58(2)(b)," insert "58(2)(c), 58(2)(d),".

7Lodgeable infringement offences—Mineral Resources (Sustainable Development) Act 1990

In item 7C.1 of Schedule 4 to the Principal Regulations after "62(3)" insert ", 80(4A)".

8Lodgeable infringement offences—Motor Car Traders Act 1986

(1)In item 8.1 of Schedule 4 to the Principal Regulations omit "43(1B),".

(2)In item 8.2 of Schedule 4 to the Principal Regulations—

(a)after "19(2)," insert "19(7A),";

(b)for "and 21(2)" substitute ", 21(2) and 24A".

9New item 11B inserted into Schedule 4

After item 11A of Schedule 4 to the Principal Regulations insert—

"11B Sale of Land Act 1962

11B.1Sections 33B(1), 33B(2), 33B(4), 33B(5) and 43.

11B.2Regulations 6(1), 6(2), 6(3), 6(4) and 6(5) of the Sale of Land (Public Auctions) Regulations 2014.".
