Infringements (General) Further Amendment Regulations 2008

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Infringements (General) Regulations 2006 to prescribe certain infringement offences under the Crimes Act 1958, the Domestic (Feral and Nuisance) Animals Act 1994, the Impounding of Livestock Act 1994, the Introduction Agents Act 1997, the Liquor Control Reform Act 1998, the Road Safety Act 1986, the Summary Offences Act 1966, the Trade Measurement Regulations 2007, the Transport Act 1983 and the Travel Agents Act 1986 as "lodgeable infringement offences" for the purposes of the Infringements Act 2006.

2Authorising provision

These Regulations are made under section 168 of the Infringements Act 2006.

3Commencement

These Regulations come into operation on 16 September 2008.

4Principal Regulations

In these Regulations, the Infringements (General) Regulations 2006[1] are called the Principal Regulations.

5Schedule 3—New items inserted

(1)After item 1 in Schedule 3 to the Principal Regulations insert—

"1A Crimes Act 1958

1B.1Sections 10(1), 10(2), 10(3), 12A, 20(1), 21 and 22.

(2)After item 6 in Schedule 3 to the Principal Regulations insert—

6B.1Sections 29(1), 35, 36(2), 36(4), 38(1) and 38(2).".

(3)After item 10 in Schedule 3 to the Principal Regulations insert—

"10AA Summary Offences Act 1966

10AA.1Sections 9(1)(c), 17(1)(c) and 17(1)(d).".

(4)After item 11 in Schedule 3 to the Principal Regulations insert—

"11A Travel Agents Act 1986

11A.1Sections 8(5), 11A(2), 12(2), 14(1), 17(11), 18, 18A(3), 24, 30, 31, 32(1), 41(1) and 41(3).".

6Schedule 3—Liquor Control Reform Act 1998

In item 7.3 in Schedule 3 to the Principal Regulations, for "114(a), 114(b), 114(c)," substitute "113(1), 114(1), 114(2),".

7Schedule 3—Road Safety Act 1986

(1)In item 9A.1 in Schedule 3 to the Principal Regulations, after "Sections" insert "18(1)(b),".

(2)After item 9A.1 in Schedule 3 to the Principal Regulations insert—

"9A.1ASection 65 where the offence is alleged to have been committed by a person who is the holder of a full driver licence.".

(3)For item 9A.3 in Schedule 3 to the Principal Regulations substitute—

"9A.3Regulations 211A, 211B(1)(a), 211B(1)(b), 211B(2)(a), 211B(2)(b), 211C and 219A of the Road Safety (Drivers) Regulations 1999.".

8Schedule 3—Trade Measurement Regulations 2007

In item 10B.5 in Schedule 3 to the Principal Regulations for "26(1)(c), 26(1)(d)," substitute "25(3), 26,".

9Schedule 3—Transport Act 1983

(1)In item 11.1AA in Schedule 3 to the Principal Regulations—

(a)after "Sections" insert "131, 133B, 134(4), 134A(2), 135E(1), 135F(5), 137A(4), 144(1A), 144(4), 158A(1), 158A(2),";

(b)after "169B," insert "169EC,";
