Infringements (General) Further Amendment (Lodgeable Infringement Offences) Regulations 2013

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Infringements (General) Regulations 2006—

(a)to prescribe certain infringement offences under the Road Safety Act 1986, the Agricultural and Veterinary Chemicals (Control of Use) Act 1992, the Bail Act 1977, the Education and Training Reform Act 2006, the Marine Safety Act 2010, and the Mineral Resources (Sustainable Development) Act 1990, as lodgeable infringement offences for the purposes of the Infringements Act 2006; and

(b)to make other minor consequential amendments.

2Authorising provision

These Regulations are made under section 168 of the Infringements Act 2006.

3Commencement

These Regulations come into operation on 1 January 2014.

4Principal Regulations

In these Regulations, the Infringements (General) Regulations 2006[1] are called the Principal Regulations.

5Lodgeable Infringement Offences—Road Safety Act 1986

(1)In item 9A.1 of Schedule 3 to the Principal Regulations—

(a)for "59(1)(a) and (3)" substitute "59(1)(a) and (2)";

(b)for "174(1) and 175(1)" substitute "174(1), 175(1), 184(2), 185(2), 185(3), 186(1) and 186(2)".

(2)After item 9A.1A of Schedule 3 to the Principal Regulations, insert

"9A.1BSections 191L(2)(a), 191L(2)(b), 191L(4), 191M(2)(a), 191M(2)(b), 191M(4), 191N(2)(a), 191N(2)(b), 191N(4), 191O(2)(a), 191O(2)(b), 191O(4), 191P(2)(a), 191P(2)(b), 191P(4), 191R(3), 191T(2), 191T(3), 191T(4), 191U(1), 191U(2), 191U(3), 191V(3), 191V(4), 191W(3), 191Y(7), 191Y(9), 191ZO(1), 191ZO(2), and 191ZY(1).

9A.1CSections 191Q(2) and 191Q(4) and 191QA(1), 191Q(2) and 191Q(4) and 191QA(2), 191Q(2A) and 191Q(4) and 191QA(2), 191T(6), 191V(2), 191ZN(3), 191ZO(2), 191ZOA(1), 191ZOA(2), 191ZOA(3), 191ZW(1), 191ZW(3) and 191ZX(3).".

(3)In item 9A.9 of Schedule 3 to the Principal Regulations, for "67(2) and 81" substitute


"67(2), 81, 101(3), 101(4), 104(3), 105(3) and 105(6)".

(4)In item 9A.10 of Schedule 3 to the Principal Regulations—

(a)after "198(3)," insert "240(1),";

(b)after "253(4)," insert "257(1), 258(1), 258(2), 259(1),".

6Lodgeable Infringement Offences—Agricultural and Veterinary Chemicals (Control of Use) Act 1992

In item 1B.1 of Schedule 4 to the Principal Regulations, for "52AA and 67A(1)" substitute "67A(1) and 67B(1)".

7Lodgeable Infringement Offences—Bail Act 1977

After item 1C of Schedule 4 to the Principal Regulations insert

"1CA Bail Act 1977

1CA.1Section 30A.".

8Lodgeable Infringement Offences—Education and Training Reform Act 2006

After item 3A of Schedule 4 to the Principal Regulations insert

"3B Education and Training Reform Act 2006

3B.1Section 2.1.21(1), 2.1.21(2), 2.1.21(3) and 2.1.21(4).".

9Lodgeable Infringement Offences—Marine Safety Act 2010

(1)In item 7BA.1 of Schedule 4 to the Principal Regulations, for "59, 61, 62(1) and 62(2)" substitute "59 and 61".

(2)Item 7BA.2 of Schedule 4 to the Principal Regulations is revoked.

(3)Item 7BA.3 of Schedule 4 to the Principal Regulations is revoked.

(4)In item 7BA.4 of Schedule 4 to the Principal Regulations omit "67(1), 67(2), 73(1), 73(2), 74,".

10Lodgeable Infringement Offences—Mineral Resources (Sustainable Development) Act 1990

For items 7C.1 and 7C.2 of Schedule 4 to the Principal Regulations substitute

"7C.1Sections 8, 38AA(1), 38AE, 39(1), 39(3), 39(5), 43(1), 58(1)(a), 58(1)(b), 58(1)(c), 58(1)(d), 58(2), 62(1)(a), 62(1)(b), 62(1)(c), 62(1)(d), 62(2), 62(3) and 80(6).

7C.2Regulations 9(1), 24(3), 26, 35(1), 35(3) and 36(2) of the Mineral Resources (Sustainable Development) (Mineral Industries) Regulations 2013.".
