Infringements (General) (Amendment) Regulations 2007

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Infringements (General) Regulations 2006 to prescribe certain infringement offences under the Estate Agents Act 1980, the Extractive Industries Development Act 1995, the Liquor Control Reform Act 1998, the Private Security Act 2004, the Road Safety Act 1986, the Tobacco Act 1987, the Trade Measurement Act 1995 and the Transport Act 1983 as "lodgeable infringement offences" for the purposes of the Infringements Act 2006.

2Authorising provision

These Regulations are made under section 168 of the Infringements Act 2006.

3Commencement

These Regulations come into operation on 2 October 2007.

4Schedule 3—Lodgeable infringement offences

(1)In Schedule 3 to the Infringements (General) Regulations 2006[1] in item 2.2, for "and" (where first occurring) substitute ", 36 and".

(2)In Schedule 3 to the Infringements (General) Regulations 2006 after item 3.1 insert

"3.2Regulation 11 of the Extractive Industries Development Regulations 2007[2].".

(3)In Schedule 3 to the Infringements (General) Regulations 2006 after item 7.1 insert

"7.2Sections 98, 99, 100(a), 100(b), 100(c), 100(e), 101, 101B(2), 102(1), 102(2), 103(1), 103(2) and 105(1).

7.3Sections 108(1)(a), 108(1)(b), 108(1)(c), 108(1)(d), 108(1)(e), 108A(2), 108B(1), 108B(2), 109(1), 111(a), 114(a), 114(b), 114(c), 115(1), 116(a), 116(b), 118A(a) and 118A(b).

7.4Sections 119(1), 119(2), 119(3), 119(4), 120(1), 121, 122(1), 123(1), 123(4), 124(1), 124(2), 124(3), 125(1), 125(2), 126(4), 130(3)(a) and 130(3)(b).

7.5Regulations 5(1), 5(2) and 6 of the Liquor Control Reform (Prohibited Supply) Regulations 2005[3].".

(4)In Schedule 3 to the Infringements (General) Regulations 2006 after item 8 insert

"8A Private Security Act 2004

8A.1Sections 59(1), 62(1), 114(1), 117(1), 128(3), 129(2), 129(4), 133, 134(1), 134(2), 138, 141(1), 176(1) and 176(2).

8A.2Regulations 57(1), 67(a) and 67(b) of the Private Security Regulations 2005[4].".

(5)In Schedule 3 to the Infringements (General) Regulations 2006 after item 9 insert

"9A Road Safety Act 1986

9A.1Sections 19(8), 22(6), 60 and 60A.

9A.2Rules 300(1)(a) and 300(1)(b) of the Road Rules, as incorporated by the Road Safety (Road Rules) Regulations 1999[5].

9A.3Regulation 211A(1) of the Road Safety (Drivers) Regulations 1999[6].".

(6)In Schedule 3 to the Infringements (General) Regulations 2006 after item 10 insert

"10A Tobacco Act 1987

10A.1Sections 5C(1), 5D(1) and 5E(1).

10BTrade Measurement Act 1995

10B.1Sections 7(1), 7(2), 7A, 7B, 8(1), 8(2), 9(2), 18(2), 22(3) and 24.

10B.2Section 28(1) constituted by a contravention of regulation 59(1) or 61(1) of the Trade Measurement Regulations 2007[7].

10B.3Section 28(2) constituted by a contravention of regulation 59(1) or 61(1) of the Trade Measurement Regulations 2007.

10B.4Sections 31(1), 32(1)(a), 32(1)(b), 42(1), 43(1) and 65(b).

(7)In Schedule 3 to the Infringements (General) Regulations 2006 before item 11.1 insert

"11.1AASections 165(1)(a), 165(1)(b), 169B, 169R, 169S, 169T(1), 169T(2), 169U, 169V, 169W and 169X.".

(8)In Schedule 3 to the Infringements (General) Regulations 2006 in item 11.3 for "8(3), 8(4)" substitute "6(2), 8".
