An Act to consolidate the enactments providing for the care and education of infants who may be convicted of felony or misdemeanour.

BE it enacted by the K i n g ' s Mos t Exce l l en t Majesty by and wi th t h e advice and consent of t he Legislat ive Counci l a n d Legislat ive
Assembly of N e w South Wales in P a r l i a m e n t assembled and by the
a u t h o r i t y of t h e same as follows :—
1. This A c t m a y be cited as t h e " I n f a n t Convicts Adopt ion

Act , 1 9 0 1 . "

2.    The A c t men t ioned in t h e Schedule here to is he reby repealed.

3.    I n this A c t , —

" C o u r t " means t he Supreme Court .
" J u d g e " means J u d g e of t he Sup reme Cour t .
4. (1) WheneA'er a n y in fan t u n d e r t he age of n ine teen years is

convicted of felony or mi sdemeanour t h e Cour t or a J u d g e m a y if of opinion t h a t it will be for t h e infant ' s benefit m a k e a n order ass igning the care or cus tody of such in fan t du r ing his minor i ty or pa r t thereof to a n y appl icant who is wi l l ing to t ake charge of h im and provide for

his m a i n t e n a n c e and educat ion.
(2) The Cour t or J u d g e in deal ing wi th such applicat ion

shall have regard to t he prevent ion of c r ime the age of t h e infant and the c i rcumstances habi t s and charac te r of his paren ts or t e s t amen ta ry

or n a t u r a l guard ian .

(3) The Court or J u d g e m a y a t t ach to every order such t e rms a n d conditions and such regula t ions respect ing the ma in t enance educat ion a n d care of the infant as i t or he t h inks proper and shall in every case direct t h a t t he in fan t shall not du r ing t h e con t inuance of t he order be seat beyond the seas or ou t of t he jur isdic t ion of t h e Court .

5. Eve ry order shall be b ind ing upon the fa ther a n d t e s t amenta ry

or n a t u r a l gua rd ian of t h e infant and no person shall be ent i t led to use or exercise over the infant any power or control inconsis tent wi th

t he order.
6. The Cour t m a y a t any t i m e rescind any order or from t ime to t ime rescind or vary t he t e rms condit ions or regula t ions a t t ached
there to .

7. (1) The Cour t m a y if any appl icat ion does not appear to be well founded award costs agains t the appl icant .

(2) Such costs shall be payable to any pa ren t or t e s t amen ta ry
or n a t u r a l gua rd ian who opposes t h e applicat ion.

8. (1) No fee reward emolumen t or g ra tu i ty whatsoever shall be demanded t aken or received by any officer or Minis ter of the Cour t for any m a t t e r or t h i n g done in the Court or by or before a J u d g e in pursuance of th is Act .

(2) U p o n t h e m a k i n g or opposing of any applicat ion a

J u d g e may assign counsel and a t to rney to advise and carry on or to oppose t he appl icat ion who are hereby required to do the i r duties there in w i thou t fee or reward.

9. No th ing contained in th is A c t shall affect or in any m a n n e r

interfere wi th t h e execut ion of t he sentence passed upon such infant
