1 Name
This instrument is the Industry Research and Development (Square Kilometre Array Program) Instrument 2022.
2 Commencement
(1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3 Authority
This instrument is made under section 33 of the Industry Research and Development Act 1986.
4 Definitions
In this instrument:
Act means the Industry Research and Development Act 1986.
AusSRC means the Regional Centre established in Australia.
Regional Centre means a part of the SRC network established in a particular country or group of countries.
SKA Convention means the Convention Establishing the Square Kilometre Array Observatory done at Rome on 12 March 2019.
SKA Project has the same meaning as in Article 1 of the SKA Convention.
Note: Article 1 provides that: ‘“SKA Project” means the global effort to build, maintain, operate and ultimately decommission the SKA.’
SKAO has the same meaning as in Article 1 of the SKA Convention.
Note: Article 1 provides that ‘“SKAO” means the Square Kilometre Array Observatory’.
SRC network means the international network of computing and data management infrastructure established for the purpose of giving users access to SKA telescope data products, and to the tools and capabilities needed to interact with and analyse these data products.
5 Prescribed program
(1) For the purposes of subsection 33(1) of the Act, the Square Kilometre Array Program (the program) is prescribed.
(2) The program provides funding to enable the Commonwealth to do the following:
(a) support SKAO and the SKA Project;
(b) support and promote diplomatic efforts in relation to the SKA Project;
(c) engage in enterprises and activities related to providing and operating the SKAO telescope to be hosted in Australia;
(d) provide funding and other resources for AusSRC to:
(i) deliver Australia’s contribution to the SRC network; and
(ii) have a specific focus on Australian-lead research programs, multidisciplinary research, translation of data techniques, tools and skills to industry, and education in science, technology, engineering and mathematics;
(f) engage in other enterprises and activities related to the SKA Project and AusSRC.
(3) The purpose of the program is to support:
(a) Australia’s engagement in the SKA Project; and
(b) Australian research and development utilising the SRC network and infrastructure.
6 Specified legislative power
For the purposes of subsection 33(3) of the Act, the powers of the Parliament to make laws with respect to the following are specified:
(a) astronomical and meteorological observations (within the meaning of paragraph 51(viii) of the Constitution);
(b) external affairs (within the meaning of paragraph 51(xxix) of the Constitution);
(c) enterprises and activities that are peculiarly adapted to the government of a nation and cannot otherwise be carried on for the benefit of the nation (see paragraph 51(xxxix) and section 61 of the Constitution).
