1  Name

This instrument is the Industry Research and Development (Automotive Engineering Graduate Program) Instrument 2018.

2  Commencement

(1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

This instrument is made under section 33 of the Industry Research and Development Act 1986.

4  Definitions

In this instrument:

Act means the Industry Research and Development Act 1986.

higher education provider has the same meaning as in the Higher Education Support Act 2003.

5  Prescribed program

For the purposes of subsection 33(1) of the Act, the program specified in item 1 of the following table is prescribed.

1	Automotive Engineering Graduate Program	The program provides funding to higher education providers to provide grants to students to undertake research with industry in areas of knowledge identified as priorities for developing the capabilities, and competitive advantage, of Australia’s automotive engineering industry.

6  Specified legislative power

For the purposes of subsection 33(3) of the Act, the following legislative powers of the Parliament are specified:

(a)  to make laws with respect to foreign corporations and trading or financial corporations formed within the limits of the Commonwealth;

(b)  to make laws incidental to the execution of the executive power of the Commonwealth;

(c) to make laws under section 122 of the Constitution for the government of a Territory.

7  Eligibility criteria relating to program

For the purposes of subsection 33(4) of the Act, the eligibility criteria relating to the program includes the requirement that applicants must be Table A providers or Table B providers within the meaning of the Higher Education Support Act 2003.
