430 Industry and Commerce Training Act Amendment Act 1983, No. 35 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Industry and Commerce Training Act Amendment Act 1983. (2) In this Act the Industry and Commerce Training Act1979-1982 is referred to as the Principal Act. (3) The Principal Act as amended by this Act may be 'cited as the Industry and Commerce Training Act1979-1983. 2. Amendment of s. 5. Interpretation . Section 5 of the Principal Act is amended by, in subsection (1), inserting after the definition Minister " the following definition:- " ooccccuuppaation " includes any trade whether or not a trade prescribed by Order in Council under section 9 (1);". 3. Repeal of and new s. 9. The Principal Act is amended by repealing section 9 and substituting the following section:- " 9. Trades that are apprenticeship callings. 1 . The provisions of this Act that provide for or in connexion with apprenticeships or apprentices apply to trades prescribed by Order in Council, whether made before or after the commencement of the Industry and Commerce Training Act Amendment Act 1983, and the trades so prescribed are apprenticeship callings. (2) A trade may be prescribed under subsection (1) in relation to an industry specified in the Order in Council and in such case the trade is one to which the provisions referred to in that subsection apply and is an apprenticeship calling only in so far as it relates to that industry.". 4. Amendment of s. 102 . Trainee technicians . Section 102 of the Principal Act is amended by- (a) re-numbering subsection (5) as subsection (6); (b) inserting after subsection (4) the following subsection:- " (5) The Commission shall, upon the successful completion of a course of instruction by a trainee technician, issue to him a certificate in the prescribed form.". 5. Amendment of s. 103A. Commission may issue certificate in respect of recognized work or training . Section 103A of the Principal Act is amended by omitting subsections (3) and (4) and substituting the following subsections:- " (3) The Commission shall cause to be made an investigation into the work or training or both performed or undertaken by the applicant and if, as a result of the investigation, the Commission is
Industry and Commerce Training Act Amendment Act 1983, No. 35 431 of the opinion that the applicant has had experience and has expertise in a particular occupation sufficient to qualify him as the holder of a status in relation to that occupation, the Commission may recognize his work or training or both and issue to him a certificate in the prescribed form to the effect that he is qualified to hold that status and is entitled as specified in the certificate. (4) A person to whom a certificate is issued under subsection (3) shall be deemed to hold the status referred to in the certificate and shall have all the entitlements therein referred to.".
