AN ACT to amend the Industry (Advances) Act

1947-1980.

[Assented to 26 August 1982.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Industry 2,Tgattlieon.

1980 is referred to as the principal Act.

The principal Act as amended by this Act may

be cited as the Industry (Advances) Act 1947-1982.

Section 3

Section 3 of the principal Act is amended in subsection (2) by deleting "in accordance with a direction given under this Act." after paragraph (e) and inserting that passage in paragraph (e) after subparagraph (iii).

Section 7A of the principal Act is amended

(a) in subsection (1)-

(i)    by deleting "competition in the same field of activity in the State with" in subparagraph (ii) of paragraph (a) and substituting the following

conflict with the interests in the same field of activity in the State of " ; and

(ii)  by deleting subparagraph (i) of paragraph (c) and substituting the following subparagraph

(4. (i) the proposal relates to the

establishment of an indus-

try not likely to be in conflict with the interests in the same field of activity in the State of existing businesses which have not benefited from Government assist- ance; " ;

and

(b)

in paragraph (b) of subsection (2), by deleting "a business was, at the time of approval of the application under this Act, likely to be in competition with" and sub- stituting the following

the establishment or development of an industry would, at the time of approval of the application under this Act, have been likely to be in conflict with the interests in the same field of activity in the State of " .
