r1 2 r5 Industrial Relations (Tribunals) Amendment Rule No. 296, 2001 (No. 2) 2001 1 Short title This rule may be cited as the Industrial Relations (Tribunals) Amendment Rule (No. 2) 2001 . 2 Commencement (1) Rule 6 commences on 1 May 2002. (2) Rules 4, 5, 7 and 8 commence on 1 January 2002. 3 Rules amended This rule amends the Industrial Relations (Tribunals) Rules 2000. 4 Amendment of pt 2, div 2, sdiv 10, hdg Part 2, division 2, subdivision 10, heading, ‘ and expenses ’— omit . 5 Replacement of r 66 (Costs and expenses) Rule 66— omit, insert — ‘66 Costs ‘ (1) If the court or commission makes an order for costs under section 335 1 of the Act, the court or commission, in making the order, may have regard to— (a) for a proceeding before the commission—the costs payable on the scale of costs for Magistrates Courts under the Uniform CivilProcedure Rules 1999 , schedule 3; 2 or 1 Section 335 (Costs) of the Act 2 UniformCivilProcedureRules1999 , schedule 3 (Scale of costs—Magistrates Courts)

r6 3 r7 Industrial Relations (Tribunals) Amendment Rule No. 296, 2001 (No. 2) 2001 (b) for a proceeding before the full bench—the costs payable on the scale of costs for the District Court under the UniformCivilProcedure Rules 1999 , schedule 2; 3 or (c) for a proceeding before the court—the costs payable on the scale of costs for the Supreme Court under the UniformCivilProcedure Rules 1999 , schedule 1; 4 or (d) any other relevant factor. ‘ (2) The court may order that costs be assessed by the registrar and, in assessing costs, the registrar may have regard to the UniformCivilProcedure Rules 1999 , chapter 17, part 2. 5 ’. 6 Insertion of new rr 131A and 131B Part 9, before rule 132— insert — ‘131A Approved forms for applications—Act, s 125 ‘An application under section 125 6 of the Act must be in the non-chapter 12 approved form. ‘131B Making or amending awards that relate to remuneration of employees ‘An affidavit accompanying an application under section 125 of the Actto make or amend an award that relates to remuneration of employees must state the facts relied on to show that the award or amendment of the award provides for equal remuneration for men and women employees for work of equal or comparable value.’. 7 Insertion of new r 201A Part 17, after rule 201— 3 Uniform Civil Procedure Rules 1999 , schedule 2 (Scale of costs—District Court) 4 Uniform Civil Procedure Rules 1999 , schedule 1 (Scale of costs—Supreme Court) 5 Uniform Civil Procedure Rules 1999 , chapter 17 (Costs), part 2 (Costs) 6 Section 125 (Making, amending and repealing awards) of the Act

r8 4 r8 Industrial Relations (Tribunals) Amendment Rule No. 296, 2001 (No. 2) 2001 insert— ‘201A Vacations and holidays ‘ (1) The vacations and holidays of the court and commission are the same as the Supreme Court at Brisbane but may be rearranged by approval of the commissioner administrator. ‘ (2) However, the court or commission may deal with business arising during a vacation, if the court or commission considers it necessary.’. 8 Replacement of sch 1 (Fees) Schedule 1— omit, insert — ‘SCHEDULE 1 ‘FEES IN COURT, COMMISSION OR REGISTRY rule 192 1.
