Industrial Relations (Transitional) Regulation 2012 [s 1] 1 Short title This regulation may be cited as the Industrial Relations (Transitional) Regulation 2012 . 2 Commencement This regulation is taken to have commenced on 12 June 2012. 3 Declaration that regulation is a transitional regulation This regulation is a transitional regulation. Note — Under section 784(5) of the Act, this regulation expires on 12 June 2014. 4 Provision about certification of agreement approved by employees under the Act, s 147A (1) This section applies if— (a) under section 147A of the Act, an employer requests the employees who will be bound by a proposed agreement to approve it; and (b) a valid majority of the employees approve the proposed agreement. (2) For section 156 of the Act, if— (a) a step was taken by a relevant employee organisation, in negotiating the proposed agreement with the employer, to comply with a requirement under the Act; and (b) the relevant employee organisation complied with the requirement as it applied to the proposed agreement; the requirement is taken to have been complied with as it applies to the agreement made by the employer with the employees. Example — For paragraph (a), the step taken was that a relevant employee organisation advised the employer, under section 143(2) of the Act, of Page 2 2012 SL No. 104
Industrial Relations (Transitional) Regulation 2012 [s 4] the organisation’s intention to begin negotiations for the proposed agreement. For section 156 of the Act, section 143(2) of the Act is taken to have been complied with for the agreement made by the employer with the employees.
