Industrial Relations Regulations 2(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Industrial Relations Act 1988.

1.   Amendment

1.1   The Industrial Relations Regulations are amended as set out in these Regulations.

[NOTE: These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48]

2.   Regulation 87 (Ballot papers—forms)

2.1   Add at the end:

“(5)

The electoral official conducting a ballot may include in the ballot paper:

  • (a)

    directions to be followed by a person voting in that ballot so that the person’s vote complies with a provision of these Regulations; and

  • (b)

    other directions that the official reasonably believes will assist in ensuring that an irregularity does not occur in the conduct of the ballot; and

  • (c)

    notes to assist a person voting in the ballot by informing him or her of matters relating to conduct of the ballot.”.

3.   Regulation 89 (Dispatch of ballot papers—secret postal ballots)

3.1   Paragraph 89 (d):

After “envelope”, insert “(called a ‘pre-paid envelope’)”.

4.   Regulation 92 (Manner of voting)

4.1   Add at the end:

  • “(2)

    After recording his or her vote, a person voting must:

  • (a)

    comply with any direction under paragraph 87 (5) (b); and

  • (b)

    place the ballot paper in the pre-paid envelope and seal the envelope; and

  • (c)

    send the pre-paid envelope to the electoral official conducting the ballot so as to reach him or her not later than the time on the closing day of the ballot that is noted on the ballot paper.”.

5.   Regulation 94 (Scrutiny)

5.1   Paragraph 94 (4) (b):

Omit “or the envelope containing it”.

5.2   Subregulation 94 (4):

Add at the end:

 “; or

  • (d)

    material referred to in paragraph 89 (c) that is returned with the ballot paper does not comply with a direction given under paragraph 87 (5) (b); or

  • (e)

    the voter’s pre-paid envelope contains the ballot paper of another voter.”.
