Industrial Relations Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council and under section 4 of the Acts Interpretation Act 1901, make the following Regulations under the Industrial Relations Act 1988.

1.   Amendment

1.1   The Industrial Relations Regulations are amended as set out in these Regulations.

[NOTE: These Regulations commence on gazettal: see Acts Interpretation Act 1901, s.48.]

2.   New regulation 14A

2.1   After regulation 14, insert:

Certification of agreements

 “14A. (1) An application for the certification of an agreement under section 134C is not complete unless each organisation that is a party to the agreement has presented to the Commission:

  • (a)

    a copy of the memorandum of agreement signed by the parties to the agreement; and

  • (b)

    either:

    • (i)

      a statutory declaration made by an officer of the organisation authorised for the purpose by the committee of management declaring that the committee of management has approved the terms of the agreement; or

    • (ii)

      a statutory declaration made by an officer of the organisation authorised by the committee of management to approve the terms of an agreement on behalf of the organisation, declaring that the officer has approved the terms of the agreement.

“(2)

A statutory declaration must specify:

(a)

the name of the person making the declaration; and

(b)

the position in the organisation held by the person; and

(c)

the source of the person’s authority to make the declaration.”.
