Industrial Relations Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Workplace Relations Act 1996.

1.   Commencement

1.1 These Regulations commence on the date of commencement of Schedule 3 to the Workplace Relations and Other Legislation Amendment Act 1996.

2.   Amendment

2.1   The Industrial Relations Regulations are amended as set out in these Regulations.

3.   Regulation 1 (Citation)

3.1   Omit the regulation, substitute:

Citation

 “1. These Regulations may be cited as the Workplace Relations Regulations.”.

4.   Regulation 2 (Interpretation)

4.1   Definition of “the Act”:

Omit the definition, substitute:

‘the Act’ means the Workplace Relations Act 1996.”.

5.   New Part IIIA

5.1   After regulation 8, insert:

PART IIIA—THE EMPLOYMENT ADVOCATE

Division 1—Authorised officers

Identity cards—prescribed form

 “8A.For subsection 83BG (3) of the Act, Form 1A is prescribed.

Taking of samples

 “8B.For paragraph 83BH (4) (b) of the Act, an authorised officer may take a sample of any goods or substances after giving notice to the owner or other person in charge of the goods or substances, or an appropriate employee or other representative of that owner or person, of the authorised officer’s intention to do so.

Division 2—Appointment, conditions of appointment etc. of Employment Advocate

Remuneration and allowances

 “8C.For subsection 83BJ (2) of the Act, the Employment Advocate is to be paid the allowances payable to a Senior Executive Service officer of the Australian Public Service.”.

6.   Schedule 1

6.1   Before Form 1, insert:

6.2   Omit from the following forms “Industrial Relations Act 1988”, substitute “Workplace Relations Act 1996”:

  • (a)

    forms in which the expression to be omitted occurs only in the heading:

 Forms 3, 4, 7, 8, 9, 10 and 11;

  • (b)

    forms in which the expression to be omitted occurs in the heading and once elsewhere in the form:

 Forms 1, 2 and 12.
