s1 2 s5 Industrial Relations Amendment Regulation (No. 1) No. 297, 2001 2001 1 Short title This regulation may be cited as the Industrial Relations Amendment Regulation (No. 1) 2001 . 2 Commencement Sections 5, 6 and 7 of this regulation commence on 1 May 2002. 3 Regulation amended This regulation amends the Industrial Relations Regulation 2000. 4 Amendment of s 4 (Prescribed amount—Act, ss 72 and 276) (1) Section 4, ‘(2)(f)(iii)’— omit, insert— ‘ (3)(f)(iii)’. (2) Section 4, ‘$71 200’— omit , insert— ‘$75 200’. 5 Amendment of s 9 (Agreement for certification to be accompanied by affidavit—Act, s 156) (1) Section 9(1)(n), ‘and’— omit . (2) Section 9(1)— insert — ‘(p) a statement that the requirement for equal remuneration of employees under section 156(1)(l) or (m) of the Act 1 is met; 1 S ection 156 (Certifying an agreement) of the Act

s6 3 s8 Industrial Relations Amendment Regulation (No. 1) No. 297, 2001 2001 (q) a statement that the agreement passes the no-disadvantage test under chapter 6, part 1, division 3 of the Act. 2 ’. 6 Amendment of s 12 (Matters to be included in QWA—Act, s 193) Section 12(1), ‘section 193(1)’— omit , insert — ‘section 193(1)(a)’. 7 Amendment of s 13 (Filing requirements—Act, s 200) (1) Section 13(1)(k)— renumber as section 13(1)(l). (2) Section 13(1)— insert— ‘(k) a statement that the QWA meets the requirement for equal remuneration of the employee under section 193(1)(b) of the Act; 3 ’ (3) Section 13(1)— insert— ‘(m) a statement that the QWA passes the no-disadvantage test under chapter 6, part 2, division 6. 4 ’. 8 Amendment of s 49 (Management committee must report insolvency to members) (1) Section 49(3) and (4)— omit, insert— 2 Chapter 6 (Agreements), part 1 (Certified agreements), division 3 (No-disadvantage test) of the Act 3 S ection 193 (Matters to be included in QWA) of the Act 4 C hapter 6 (Agreements), part 2 (Queensland workplace agreeements), division 6 (No-disadvantage test) of the Act

Maximum penalty—20 penalty units.’. (2) Section 49(5)— renumber as section 49(4). 9 Amendment of s 68 (Withdrawal ballot exemption—recognising federal ballot) Section 68(1)(b), ‘section 235ZQ’— omit , insert — ‘section 253ZQ’. 10 Amendment of s 90 (Withdrawal ballot exemption—recognising federal ballot) Section 90(1)(b), ‘section 235ZQ’— omit , insert — ‘section 253ZQ’. 11 Amendment of s 101 (Postal ballots—distributing voting material) (1) Section 101(5), ‘different’— omit. (2) Section 101— insert— ‘ (5A) The manager must give each voter a different ballot number.’. 12 Amendment of sch 3, s 14 (Distributing voting material) (1) Schedule 3, section 14(5), ‘different’— omit.
