BE it t h e advice and consent of t he Legis la t ive Council and Legis la t ive
enacted by the K i n g ' s Most Exce l l en t Majesty, by and wi th
Assembly of New South M a l e s in P a r l i a m e n t assembled, and by the

au thor i ty of t he same, as follows :—

1. This A c t m a y be cited as the " Indus t r i a l Disputes (Amend­

2. Section four of the Indus t r i a l Disputes Act , 1908, is amended

by inser t ing after the definition of " M i n i s t e r ' ' t he following

definition :—

" Necessary commodi ty " inc ludes—

(a) c o a l ;

(b) gas for l ight ing, cooking, or industrial purposes ;

(c) water for domestic pu rposes ; and

(d)

any article of food the deprivation of which may tend to endanger h u m a n life or cause serious bodily injury.

3. Section forty-two of t he said Act is amended—

(a) by omitting the words "or (b) instigates to or aids in any of
the abovement ioned a c t s " ;

(b)

by inserting next before the proviso the following words : — " If any person inst igates to or aids in any of t he above- ment ioned acts he shall be liable to impr i sonment for a period

of twelve m o n t h s . "

4. The following new sections are inserted next after section

for ty- two of the said A c t : —

42A . I f any officer of police of or above the r ank of sergeant

has reasonable grounds to believe tha t any bu i ld ing or place is being used for a mee t ing for the purpose of ins t iga t ing to, or aiding in or m a n a g i n g or a id ing in the con t inuance of a lock-out or s t r ike, he may enter such bui ld ing or place, and may if necessary obtain assistance and use force by breaking open doors or otherwise for m a k i n g such ent ry , and m a y seize any documents which he reasonably^ suspects to relate; to any lock-out or str ike, or intended lock-out or s tr ike.

42n. A mee t ing of two or more persons assembled for the

purpose of—

(a) ins t iga t ing to or a iding in a lock-out or s t r ike ; or
(b)
manag ing , direct ing, contro l l ing , or a id ing in the con t inuance

of a lock-out or s t r ike already in existence,

shall , where such lock-out or s tr ike is in respect of a necessary
commodi ty , or in respect of tin; t r anspor t services of the Sta te in

re la t ion there to , be and is hereby' declared to be unlawful .

A n y person t a k i n g par t in any such mee t ing who has reasonable grounds to believe t ha t the probable consequences of a cont inuance of such lock-out or s t r ike will be to deprive the public e i ther wholly or to a great ex t en t of the supply of a necessary commodi ty , shall be liable to imprisonment for a period of twelve mon ths .

42c. A n y person who, ei ther as pr incipal or as agent , makes or enters in to any contract or agreement , or is or cont inues to be a pr incipal of or engages in any combinat ion fir conspiracy wi th in ten t to res t ra in the t r ade of t he Sta te in any necessary commodi ty to the; d e t r i m e n t of t he publ ic shall be liable to a pena l ty not exceeding five

h u n d r e d pounds .

42D.

42D. A n y person who monopolises or a t t empt s to monopolise,

or combines or conspires with any person to monopol ise any par t of the t rade of the Sta te with intent to control, to the detr iment of the publ ic , the supply or price of any necessary commodity , shall be liable to a penal ty not exceeding live hundred pounds.

5. Section forty-live of the said Act is amended by omi t t ing

" the three last preceding sections ", and inser t ing in place thereof t he

words and figures " s e c t i o n s 42, 42B , 42c, 42i>, 43 , and 4 1 . "
