AN ACT to amend the Industrial Development

(Resumption of Land) Act, 1945.

[Assented to 9th January, 1954.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:-

and citation.	1. (1) This Act may be cited as the Industrial Development (Resumption of Land) Act Amend- ment Act, 1953.
(2) In this Act the Industrial Development (Resumption of Land) Act, 1945

Act No. 49 of 1945,

is referred to as the principal Act.

(3) The principal Act as amended by this Act may be cited as the Industrial Development (Resumption of Land) Act, 1945-1953.

2. Section six of the principal Act is amended 136

by

(a)	substituting for the words "for the estab- lishment and carrying on of" in line three of subsection (1) the words "to establish or carry on";
(b)	substituting for the word "and" where first appearing in line three of paragraph (a) of subsection (2) the word "or";
(c)	substituting for the word "and" in line two of paragraph (b) of subsection (2) the word "or";
(d)	substituting for the word "and" in line two of paragraph (c) of subsection (2) the word "or";
(e)	substituting for the word "and" in line two and where first appearing in line five of paragraph (d) of subsection (2) the word "or";
(f)	substituting for the word "and" in line two of subparagraph (ii) of paragraph (e) of subsection (2) the word "or".

3. Section twelve of the principal Act is amended S.12

by— amended.

(a)	adding after the word "on" in the last line of subsection (1) the words "or establish- ing";
(b)	substituting for the word "and" where first appearing in line three of paragraph (a) of subsection (3) the word "or";
(c)	substituting for the words "the most" in line three of paragraph (b) of subsection (3) the word "a";
(d)	substituting for the word "and" in line four of paragraph (b) of subsection (3) the word "or";
(e)	deleting paragraph (c) of subsection (3).

4. Section thirteen of the principal Act is amended Untied.

by substituting for the word "and" in line seven the

word "or".

amended. 5. Section fourteen of the principal Act is amended

by adding a subsection as follows:

(4) Where the Minister is of opinion that a person has to such a degree developed or used the land for the purpose for which it was obtained by him as to warrant the person being exempt from the provisions of this section, he may by writing under his hand grant exemption to that person from those provisions and there- upon they cease to apply to the person and the land.

added. 6. The principal Act is amended by adding a

section as follows:-

14A. Where under the provisions of section consent to the mortgaging of land, if the mort- gagee of the land so mortgaged completes the exercise of the power of sale or foreclosure fourteen of this Act the Minister gives his pursuant to the mortgage, the land is by force of this enactment freed from any condition, limitation, or other restriction created or imposed by the provisions of this Act.

added. 7. The principal Act is amended by adding a

section as follows:-

14B. The Minister may, on the recommenda- tion of the Committee, set apart and use any land which has been reserved under section nine of this Act or dedicated under section eleven of this Act for the purpose of providing or causing to be provided roads or reserves.
